Through this procedure, only within the Institute of Business Administration in the municipality of Bucharest, the teaching positions in higher education obtained in accredited institutions abroad by Romanian citizens, citizens of the member states of the European Union and from the Swiss Confederation and from third countries are automatically recognized for:
a. accredited higher education institutions from member states of the European Union, the European Economic Area, and the Swiss Confederation;
b. prestigious universities from other countries provided in the List of Prestigious Universities from other countries, approved by order of the Minister of National Education no. 5462/2018 and periodically updated;
c. other accredited higher education institutions from abroad than those mentioned, only on the basis of an international mutual recognition agreement, concluded at intergovernmental or inter-university level.
Only in the case of temporary exercise do the provisions of Law no. 200/2004 and art. 296 of LEN no. 1/2011 apply directly. Reserved, vacant, or temporarily vacant teaching positions are filled with priority by tenured teaching staff of the institution or by associated teaching staff.
The occupation of a teaching position in the Romanian higher education system is carried out in accordance with the legal norms in force.

The status of university teaching staff is found at position no. A8 in Annex no. 2 of Law no. 200/2004 regarding the recognition of diplomas and professional qualifications for regulated professions in Romania, with subsequent amendments and additions.*

The appeal is submitted to the Institute within 15 calendar days from the receipt of the decision of non-recognition; subsequently, the Institute's decision may be challenged in court.
