The state allowance for children is granted to all children up to 18 years old who are Romanian citizens, without discrimination, as well as to young people who have turned 18 and are attending high school or vocational education courses organized according to the law, until they complete them.
Young people who repeat a school year are not eligible for the state allowance, except for those who repeat for health reasons, proven with a medical certificate.
The state allowance for children is also granted to the children of foreign citizens and stateless persons residing, under the law, in Romania, if they live together with their parents.
Romanian citizens' families who do or do not carry out salaried activity in a member state and who have requested in writing the right to family benefits in that member state, but do not qualify under the provisions of the respective EU member state's law for granting them, may request the right to state allowance for children in Romania, based on an application and supporting documents, regarding the state allowance for children, as well as for regulating the payment methods of the state allowance for children.
As supporting document, the European form E411 or any other document issued by competent institutions in the respective member state, stating that the family has applied but does not have the right to family benefits in that member state, is required.
According to the provisions of art.72 from Council Regulation No.987 of September 16, 2009, within the European Union, accumulation of family benefit rights must be avoided, which is why rules were established to determine the competent priority state to pay the right.
