GRANTING OF MINIMUM INCLUSION INCOME
Procedure description
The minimum inclusion income represents financial support granted by the state in order to ensure the minimum standard of living for the prevention of the risk of poverty and has two components:
- Inclusion aid
- Aid for families with children
The establishment of the right to minimum inclusion income consists of analyzing the application and the documents presented, entering the application in the VMI micro-application, validating the information in the application, verifying the income, visiting the applicant’s domicile to confirm the accuracy of the data mentioned in the application, preparing the on-site verification sheet in order to check the data provided by the beneficiary, drawing up the synthesis report, preparing the intervention plan, drawing up the referral for granting the right to minimum inclusion income in order to issue the mayor’s decision, and granting the rights provided by law to the beneficiaries.
According to Law no.196/2016 on minimum inclusion income, individuals and families in a situation of difficulty, who meet the eligibility conditions according to the law and have their domicile/residence in the municipality of Sibiu, may benefit from minimum inclusion income.
What are the conditions for granting VMI?
To benefit from minimum inclusion income, interested persons must meet the following general conditions:
ü They must not have sufficient income to ensure a minimum standard of living.
ü For single persons/families up to 65 years old who obtain an adjusted net income less than or equal to the maximum level established by law, respectively 346 lei.
ü For single persons aged at least 65 who obtain an adjusted net income less than or equal to the maximum level established by law, respectively 504 lei.
ü To have adjusted net monthly incomes of up to 880 lei, for granting the aid for families with children.
ü To fill in the application for granting the minimum inclusion income and to provide supporting documents.
ü The application will be analyzed by DAS Sibiu representatives to verify the fulfillment of the eligibility conditions for VMI. Verification of submitted documents will be carried out and, depending on the situation, the on-site verification sheet will be made at the declared domicile/residence/home.
ü The granting of VMI must be approved by the mayor’s decision.
To benefit from inclusion aid, one of the adult able-to-work members of the family is required to perform monthly actions or works of local interest, respecting the normal working time and health and safety regulations at work. Failure to fulfill the obligation to perform activities or works of local interest leads to suspension of payment of the inclusion aid for a maximum period of 3 months and, respectively, to termination of payment if the obligation is not fulfilled during the suspension period as well.
Families and single persons who own at least one of the goods listed below do not benefit from minimum inclusion income.
LIST
of goods leading to exclusion from granting minimum inclusion income
A. Immovable goods
Buildings, other living spaces apart from the home of residence, as well as land located within city limits with a surface area of over 1,200 sqm in urban areas and 2,500 sqm in rural areas, except for fencing land and the land of the house and yard
B. Movable goods
1. More than one vehicle older than 10 years, eligible to circulate on public roads
2. A motor vehicle eligible to circulate on public roads less than 10 years old, except for those used and/or adapted for transporting disabled persons
3. Motorboats, motorboats, yachts or other types of boats, except those necessary for transportation for people living in the Danube Delta Biosphere Reserve area
NOTE:
In case one or more goods owned by the single person/family beneficiary of minimum inclusion income are rented/leased/concessioned, these goods will be taken into account for the person/family who rents/leases/concession them, and for the rightful owner, the value obtained as a result of the transfer of usage rights for the asset will be taken into account.
The person or family who, besides the home of residence, owns a fractional share of another building/living space/immovable may benefit from minimum inclusion income regardless of the share size if they cannot capitalize on the respective asset through that possession.
C. Bank deposits
At least one family member owns, as account holder, one or more bank accounts/deposits whose total amount exceeds 3 times the value of the average gross salary provided by the State Social Insurance Law.
OWNERSHIP OF ONE OF THE LISTED ASSETS LEADS TO EXCLUSION FROM GRANTING THE MINIMUM INCLUSION INCOME
Appeal procedures
The mayor’s decision regarding the granting, denial, modification, suspension, termination of the rights provided by this law, the change of the holder thereof, including those relating to the recovery of sums unduly collected, may be appealed according to the provisions of the Administrative Litigation Law no. 554/2004, with subsequent amendments and completions.
