According to Article 50 of Law 273/2004 regarding the adoption procedure, "The adopter or, optionally, any of the spouses of the adoptive family, who obtains income subject to income tax, according to the provisions of Law no. 227/2015 on the Fiscal Code, with accommodations for a period of up to two years, which also includes the period amendments and subsequent additions, from salary activities and those assimilated to them or, as the case may be, from independent activities, copyright or agricultural activities, hereinafter referred to as the entitled person, may benefit from a leave for entrustment of the child for adoption, as well as from a monthly allowance.'"

According to Article 73 paragraph 3 of Government Decision 579/2016 regarding the approval of the Methodological Norms for the application of Law 273/2004 on the adoption procedure, "For the granting of the monthly allowance related to the accommodation leave, the application and supporting documents provided in paragraphs (1) and (2) shall be submitted within 10 working days from the date the court decision for entrustment for adoption was enforced and shall be registered at the county agency for payments and social inspection and, respectively, at the Bucharest municipality agency in whose administrative-territorial radius the entitled person resides, hereinafter referred to as the territorial agency."
