The domicile of the minor is with their parents or with the parent with whom they reside permanently.
The application for issuing the minor's identity card cannot be completed with another domicile address, except for the domicile address of the parents or of the parent where the minor has their domicile, according to the law.
If the parents have different domiciles, the application for issuing the identity card is signed by the parent with whom the minor has their domicile, according to the law.
For the minor who, although entrusted by court decision/agreement to one of the parents, resides permanently with the other parent, the consent declaration of the parent to whom the minor was entrusted is requested, stating their agreement for the minor's identity card to contain the address where the minor resides permanently.
The consent declaration can be given at the counter, in the presence of the public records staff, and if the parent cannot appear at the counter, the declaration must be authenticated by a public notary or, as the case may be, at the Romanian diplomatic mission in the country where the parent is located.
When submitting the documents, the minor must be accompanied by one of the parents or, as the case may be, by the legal representative, by the designated person from the specialized center under the authority of the public social assistance service, or by the person to whom the minor has been entrusted in placement.
GEO no. 97/2005, Art. 12:
(1) Within 15 days from reaching the age of 14, the minor is obliged to request the issuance of the identity card from the local community public records service;
(2) The issuance of the first identity card cannot be done based on a special power of attorney.
