Registration of computer programs imported into the territory of Romania*

For authorized natural persons or legal entities who import computer programs, they are required to register all computer programs in the National Register of Computer Programs before introducing them into commercial circulation, according to art.20 paragraph 4 of O.G. 25/2006 republished, amended and supplemented by O.U.G. 43/2010. The documents for registration must contain the following:
Standard requests - Form F8
Copies of documents:
- documentary proof of the rights holder’s agreement for distribution, commercialization, and rental activities, in authorized translation, accompanied by the annex with programs
- invoice/payment order regarding the registration operation in the register.
The fees for registration operations are provided by H.G.1086/2008, being as follows:
- up to 20 program titles including - 50 lei/request
- between 21 and 50 program titles including - 75 lei/request
- between 51 and 100 program titles including - 100 lei/request
- more than 100 program titles - 150 lei/request
- supplementary request for completing missing documents, following the rejection of the initial registration request 10 lei.
Payment is made at the ORDA cash desk located at Calea Victoriei no. 118, 5th floor, sector 1, Bucharest, or into account RO67TREZ7015005XXX000157 opened at the Treasury Sector 1, Bucharest, CUI 4266995.

The legislation does not contain special provisions regarding remedies in case of dispute, the common law provisions being applicable.
