Request for a license for the public sanitation service of localities or for one or more specific activities of this service, provided in the manner of direct management by public services of local or county interest, with legal personality, established and organized by decisions of the deliberative authorities of the administrative-territorial units - https://www.anrsc.ro/gestiune-directa-salubrizare/

Processing time: 60 days from the registration of the documentation or 30 days from the submission by the public utilities operator of the requested supplements by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the granting of the license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a notification informing them of the obligation to make additions, corrections, or clarifications, referring to the request and the submitted documents, within 30 days from the registration of the documentation.

In case within 30 days from the date of the request for supplements, the applicant does not provide all the necessary documentation as provided by the regulation, including the requested supplements, A.N.R.S.C. will return the corresponding documentation and will remove the respective request from the license granting procedure, informing the applicant of this decision.

Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) to summon the authorized representatives of the applicant to the A.N.R.S.C. headquarters, to clarify certain aspects arising/not arising from the provided documentation;

b) to verify, on-site, the accuracy of the data in the documentation sent by the applicant.

A.N.R.S.C., through its specialized department, prepares a specialist report including the justified proposal for granting/rejecting the license, which will be presented for analysis to the Licensing Commission by the commission secretary.

The proposal for granting/rejecting the license is put to vote within the Licensing Commission.

The granting/rejection of the license is made by order of the president of A.N.R.S.C..

In case of license granting, A.N.R.S.C. communicates to the applicant the invoice for the license granting fee, which must be paid within maximum 30 days from the date of the invoice communication.

After payment confirmation, A.N.R.S.C. sends to the applicant, within a maximum of 5 days, the A.N.R.S.C. president’s order for granting the license, accompanied by the license and its associated conditions.

If the 30-day deadline for payment of the license granting fee is not observed, A.N.R.S.C. will proceed with the license withdrawal.

In case of license refusal, A.N.R.S.C. sends to the applicant, within a maximum of 5 days from issuance, the A.N.R.S.C. president’s order rejecting the license, along with the reasons for refusal.

If the license granting is rejected, the applicant can no longer submit a new licensing documentation earlier than 6 months from the date of the rejection order.

Final document:

a) Order for granting the license, accompanied by the license and its associated conditions;

b) Order for rejection of the license, accompanied by the reasons for refusal;

c) Notification regarding the removal of the application from the procedure.

Notification deadline upon expiry of the resolution term: 5 days from the date of confirmation of payment of the license granting fee, in the case of license granting, or 5 days from the date the rejection order is issued.
