Details

License request for the public sanitation service of localities or for one or more specific activities of this service, provided in the form of direct management by commercial companies with the status of regional operators - https://www.anrsc.ro/gestiune-directa-salubrizare/

Processing time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities operator of the requested additions by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the granting of the license for a public utility service/activity are analyzed by A.N.R.S.C., and in if necessary, the regulatory authority sends the applicant a notification informing them of the obligation to make additions, corrections, or clarifications, regarding the application and the submitted documents, within 30 days from the registration of the documentation.

If , within 30 days from the date of the request for additions , the applicant does not provide all documentation required by the regulation, including the requested additions, A.N.R.S.C. will return the related documentation, deleting the said request from the licensing procedure, informing the applicant of this decision.

Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) summoning, at the A.N.R.S.C. headquarters, the authorized representatives of the applicant, to clarify certain aspects arising/not arising from the documentation provided;

b) verification on site, of the accuracy of the data in the documentation submitted by the applicant.

A.N.R.S.C., through its specialized department, draws up a specialist report which includes the justified proposal for granting/rejecting the license and which will be presented to the Licensing Commission for analysis, by the secretary of the commission.

The proposal to grant/reject the license is subject to a vote within the Licensing Commission.

The granting/rejection of the license is done by order of the president of A.N.R.S.C..

In case of license granting, A.N.R.S.C. communicates to the applicant the invoice for the license granting fee, which must be paid within maximum 30 days from the communication of the invoice.

After payment confirmation, A.N.R.S.C. sends the applicant within maximum 5 days, the order of the president of A.N.R.S.C. granting the license, accompanied by the license and its associated conditions.

In case of non-compliance with the 30-day deadline for payment of the license granting fee, A.N.R.S.C. will proceed to withdraw the license.

In case of refusal to grant the license, A.N.R.S.C. sends the applicant within maximum 5 days from issuance, the order of the president of A.N.R.S.C. rejecting the license, accompanied by the reasons for the refusal.

In the situation where the granting of the license has been rejected, the applicant cannot submit new licensing documentation earlier than 6 months from the date of issuance of the rejection order.

Final document:

a) Order for the granting of the license, accompanied by the license and the conditions associated with the license;

b) Order for the rejection of the license, accompanied by the reasons for refusal;

c) Notification regarding the removal of the request from the procedure.

Notification deadline upon expiration of processing time: 5 days from the date of payment confirmation of the license granting fee, in case of license approval, or 5 days from the date of issuance of the license rejection order.
