License application for the public sewage service, provided under the delegation of management by commercial companies with the status of regional operators - https://www.anrsc.ro/gestiune-delegata-apa-canal/

Processing time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities operator of the completions requested by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the purpose of granting the license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a letter informing them of the obligation to make additions, corrections, or clarifications, regarding the request and the submitted documents, within 30 days from the registration of the documentation.

If , within 30 days from the request letter for additions, the applicant does not provide all the appropriate documentation as required by the regulations, including the requested additions, A.N.R.S.C. will return the related documentation to the applicant, deleting the respective application from the licensing procedure, communicating this decision to the applicant.

Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) the summoning, to the A.N.R.S.C. headquarters, of authorized representatives of the applicant, in order to clarify certain aspects that arise/do not arise from the documentation provided;

b) on-site verification of the accuracy of the data in the documentation submitted by the applicant.

A.N.R.S.C., through the specialized department, drafts a specialty report which includes the justified proposal of granting/rejecting the license and which will be presented for analysis to the Licensing Committee by the secretary of the committee.

The proposal for granting/rejecting the license is subject to a vote within the Licensing Committee.

The granting/rejection of the license is made by order of the president of A.N.R.S.C..

In the case of license granting, A.N.R.S.C. communicates to the applicant the fiscal invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date of communication of the invoice.

After payment confirmation, A.N.R.S.C. sends the applicant, within a maximum of 5 days, the order of the president of A.N.R.S.C. for granting the license, accompanied by the license and its associated conditions.

In case the 30-day term for paying the license granting fee is not respected, A.N.R.S.C. will proceed to withdraw the license.

In case of refusal to grant the license, A.N.R.S.C. sends the applicant within a maximum of 5 days from issuance, the order of the president of A.N.R.S.C. for license rejection, accompanied by the reasons for refusing the granting.

For the situation where the license granting has been rejected, the applicant may not submit a new licensing documentation earlier than 6 months from the date of issuance of the rejection order.

Final document:

a) Order of granting the license, accompanied by the license and the conditions associated with the license;

b) Order of license rejection, accompanied by the reasons for refusal to grant;

c) Notification regarding deletion of the application from the procedure.

Notification period upon expiry of the processing deadline: 5 days from the date of confirmation of payment of the license granting fee, in the case of license granting, or 5 days from the date of issuance of the license rejection order.
