The professional maternal assistant is the natural person, certified under the conditions of the law by the Child Protection Commission, who ensures, through the activity carried out at their home, the upbringing, care, and education necessary for the harmonious development of the children who are placed or entrusted to them.

Only persons who meet the following conditions can be certified as professional maternal assistants:

•have full legal capacity;

•through their behavior in society, health status, and psychological profile, offer guarantees for the correct fulfillment of the obligations that a parent has regarding the upbringing, care, and education of their children;

•have a dwelling in use that covers the needs for food preparation, hygiene, education, and rest of its users, including those of the children who are to be placed or entrusted;

•do not carry out salaried activities;

•have attended the professional training courses organized by the specialized public service for child protection or the authorized private body that conducts the evaluation for granting the professional maternal assistant certificate.
