Uncollected social benefits of the deceased person with disabilities, representing the indemnity and/or complementary personal budget for the month in which the death occurred, and, as the case may be, social benefits due and unpaid until death, are paid to the surviving spouse, children, parents or, in their absence, other heirs, under common law, at their request. The amounts provided above may be requested at the territorial agency for payments and social inspection by the heir, within the general limitation period, based on the document proving the status of heir, as well as, in the case where there are several heirs, a statutory declaration that the other heirs are not requesting these amounts.
