Social benefits left uncollected by the deceased person with disabilities, representing the indemnity and/or complementary personal budget for the month in which the death occurred, and, as applicable, the social benefits due and unpaid until death, shall be paid to the surviving spouse, children, parents, or, in their absence, to other heirs, under the conditions of common law upon their request. The amounts mentioned above can be requested from the territorial agency for social payments and inspection by the heir within the general prescription period, based on the document certifying heir status, as well as, in the situation where there are several heirs, a declaration on their own responsibility stating that the other heirs do not request these amounts.
