In order to ensure the conditions of occupational safety and health and for the prevention of accidents and occupational diseases, employers are obliged to obtain the operating authorization from the point of view of occupational safety and health, before starting any activity. For this, the employer is obliged to submit an application, completed in two copies signed in original, accompanied by copies of the establishment documents and a declaration on their own responsibility, from which it results that for the declared activities the operating conditions provided by the specific legislation in the field of occupational safety and health are met.

All documents are submitted to the territorial labor inspectorate in whose area the respective employer carries out its activity.

The following are not authorized according to this procedure:

a) legal persons for whom the authorization of operation, including from the point of view of occupational safety and health, is carried out on the basis of Law no. 359/2004 regarding the simplification of formalities at the registration in the trade register of natural persons, family associations and legal persons, their fiscal registration, as well as the authorization of operation of legal persons, with the subsequent amendments and completions;

b) authorized natural persons who carry out economic activities, individual enterprises and family enterprises for which the procedure for registration in the trade register and for authorization of operation is regulated by the Government Emergency Ordinance no. 44/2008 regarding the carrying out of economic activities by authorized natural persons, individual enterprises and family enterprises, with subsequent amendments.

This procedure can also be carried out online, by the applicant accessing the website of the territorial labor inspectorate, a page that can be found by accessing the page https://www.inspectiamuncii.ro/contact. For sending documents, the Employer section, Authorization subsection, will be accessed. The applicant can register with the same credentials (username and password) issued for the electronic transmission of data from Revisal.
