The social benefits left uncollected by the deceased person with disabilities, representing the allowance and/or the personal complementary budget for the month in which the death occurred, and, as the case may be, the social benefits due and unpaid up to the time of death, shall be paid to the surviving spouse, children, parents or, in their absence, other heirs, under common law conditions, upon their request. The amounts mentioned above may be requested from the territorial agency for payments and social inspection by the heir, within the general statute of limitations, based on the document attesting the quality of heir, as well as, in the situation where there are several heirs, the affidavit that the other heirs do not request these amounts.
