Procedure regarding the automatic recognition of teaching positions in university education obtained in accredited higher education institutions abroad, within the "ARTIFEX" University of Bucharest*

Purpose
Through this procedure, the automatic recognition is carried out, within the "ARTIFEX" University of Bucharest, of academic teaching positions obtained in accredited foreign higher education institutions, only if they were obtained in: accredited higher education institutions in member states of the European Union, the European Economic Area, and the Swiss Confederation; prestigious higher education institutions from other countries listed in the List of prestigious universities from other countries, approved by ministerial order, periodically updated. Academic teaching positions obtained in accredited higher education institutions abroad, other than those mentioned above, may be recognized by the "ARTIFEX" University of Bucharest, provided that the minimum requirements for occupying a teaching position are met, according to the criteria provided for in art. 25, 27, 29, and 30 (except for the requirement regarding the habilitation certificate, in cases where in the national education system of the candidate's country of origin the quality of full professor implicitly confers the status of PhD supervisor) from the Competition Methodology for occupying vacant teaching positions at the "ARTIFEX" University of Bucharest.
Target audience
The procedure applies to Romanian citizens, citizens of member states of the European Union, the European Economic Area, the Swiss Confederation, and citizens of third countries.
The exercise of the rights conferred by the recognized teaching position and the occupation of teaching positions in the Romanian higher education system is carried out according to the applicable legal regulations.
Limits
The recognition of the teaching position by the "ARTIFEX" University of Bucharest is valid and produces legal effects at the university level.
Procedure description
1. File submission
For the recognition of the teaching position, the applicant submits a recognition file containing the following documents:
a) recognition request submitted in person by the applicant;
b) identity document – copy (certified by the competent authorities in the country of origin) and certified translation (if applicable);
c) proof of name change (if applicable) – copy (certified by the competent authorities in the country of origin) and certified translation (if applicable);
d) doctoral diploma – copy (certified by the issuing institution), if the degree was obtained in Romania, or doctoral diploma – copy (certified by the issuing institution) and certified translation (if applicable), if the degree was obtained abroad;
e) certificate of recognition of the doctoral degree, according to legal provisions, if the doctoral diploma was obtained abroad;
f) proof of teaching position, issued by the institutions specified in art. 11;
g) documents proving the classification of the issuing institution, according to art. 11;
h) proof of payment of the evaluation fee approved by the Decision of the Administrative Council of the "ARTIFEX" University of Bucharest;
i) habilitation certificate (if applicable), recognized according to legal provisions;
j) CV, list of publications, and scientific contributions in the field.
The file may be submitted to the general secretariat of the university or sent by post or through the "Electronic Single Contact Point" platform.
The evaluation fee, in the amount of 1,000 lei may be paid into the account of "ARTIFEX" University of Bucharest, CUI 17656965, IBAN RO42BTRLRONCRT0658609501, opened at Banca Transilvania, or at the university cashier, in cash or by bank card.
If it is found that the file does not contain the requested documents, the applicant will be notified in writing to complete it. The deadline for completing the file is a maximum of 15 calendar days from the date of notification.
The complete file is sent to the recognition committee, which will evaluate and rule on the request.
2. Evaluation procedure
For the recognition of university teaching positions obtained in accredited foreign higher education institutions, the rector of "ARTIFEX" University of Bucharest proposes to the Senate the recognition committee, which is approved by the Senate and appointed by the decision of the rector.
The recognition committee may include substitute members, specialist academic staff.
The recognition committee consists of 5 members, including: the president of the recognition committee, the university’s legal advisor or a tenured faculty member in the field of Law, and three academic staff with the title of full professor and/or associate professor, tenured at the university and/or from outside the university.
Decisions of the recognition committee are made by a simple majority of the votes cast by the committee members.If any suspicions regarding the authenticity of the study documents are found, the committee will notify the competent authorities.
The committee will prepare an Evaluation Report containing the decision (approval or rejection) regarding the recognition request.
The report prepared by the Recognition Committee, signed by all committee members and registered in the University’s Inbound/Outbound Register, is submitted for approval to the university Senate.
The recognition or non-recognition decision is issued by the rector of "ARTIFEX" University, according to the Senate decision and will be communicated to the applicant.
The processing time for applications is a maximum of 30 working days from the date of registration of the complete file. The resolution period mentioned above may be extended in justified cases, the applicant being informed in writing, by postal courier or by email.
The recognition certificate will be issued in two copies, one of which is sent to the applicant and one is archived at the university's general secretariat.
4. Issuing duplicates
In the case of loss, destruction, or deterioration of the recognition decision, "ARTIFEX" University will issue, upon request, a duplicate of it, based on a notarial statement regarding falling under one of the above-mentioned situations.
The request is made in writing and must be accompanied by an identity document - copy certified by the competent authorities in the country of origin and certified translation (if applicable), proof of name change (if applicable) - copy certified by the competent authorities in the country of origin and certified translation (if applicable), as well as proof of payment of the duplicate fee.

The Rector's decision can be appealed only once, within 10 working days from the notification, by a motivated request submitted to the general secretariat of the University or sent by mail.
The duration for resolving the appeal is 10 working days from the date of registration.
If the applicant for recognition submits an appeal, the Rector appoints an appeal committee with the same structure as the Recognition Committee, in which persons other than the members of the Recognition Committee will be appointed.
The members of the committees will decline participation in case of a possible conflict of interest specified by the regulations in force.
