PURPOSE OF THE PROCEDURE

The procedure establishes the methods by which the recognition of didactic positions in university education obtained in accredited foreign university institutions is carried out for individuals who wish to work within the “Ștefan cel Mare” University of Suceava.

SCOPE OF APPLICATION

The procedure is used within the “Ștefan cel Mare” University of Suceava for didactic positions in university education obtained in accredited foreign university institutions.

CONTENT

Didactic positions in university education obtained in accredited higher education institutions from member states of the European Union, the European Economic Area, the Swiss Confederation, and prestigious higher education institutions in other countries included in the List of prestigious universities from other countries, approved by ministerial order and updated periodically, are automatically recognized by higher education institutions in Romania.

Didactic positions obtained at other accredited higher education institutions than those mentioned in the previous paragraph, can be recognized, as applicable, with respect to the minimum requirements regarding occupying a didactic position in the Romanian higher education system in force at the date of submitting the recognition request and the requirements stipulated in Regulation R51.


For the purpose of recognizing didactic positions in university education obtained in accredited foreign higher education institutions, at USV, a recognition commission is designated by the rector, formed of at least 4 members, which includes:
a) the vice-rector for scientific research / vice-rector for didactic activity and quality assurance / the CSUD director. Two of the above will participate in the commission, as applicable, one of whom will be designated as president;
b) a legal advisor;
c) secretary. The secretary does not have decision rights within the commission.
The commission may include alternate members, specialists in the field.
The decisions of the recognition commission are taken unanimously by the president and two members. If any suspicion arises regarding the authenticity of study documents, the commission notifies the competent authorities.
The processing time of the files is a maximum of 10 days from the date of registration of the complete file. The resolution time may be extended in justified cases, with the applicant being informed in writing, by postal courier or email.
In the situation where the recognition applicant files an appeal, the Rector appoints a commission of appeal consisting of three members in which other persons than those in the Recognition Commission are designated.
The commission members will decline participation in case of possible incompatibility specified by the regulations in force.
Recognition certificates issued according to this procedure are valid and produce legal effects only within USV.

At USV, the evaluation for the recognition of didactic positions in university education obtained in accredited foreign higher education institutions is carried out only if obtained in higher education institutions accredited from member states of the European Union, the European Economic Area, the Swiss Confederation, and prestigious higher education institutions in other countries included in the List of prestigious universities from other countries, approved by ministerial order and updated periodically.
Recognition applies to Romanian citizens, citizens of member states of the European Union, the European Economic Area, the Swiss Confederation, and citizens of third states.
Employment in a didactic teaching position in the Romanian higher education system is carried out according to the legal regulations in force.
For the recognition of a didactic position, the applicant submits the recognition file, which includes the following documents:
a) recognition request (Annex 1);
b) identity document - copy - and proof of name change - copy and legalized translation (if applicable);
c) documents regarding the possession of a doctoral diploma: certified copy of the doctoral diploma, if the document was obtained in Romania or at one of the accredited university institutions mentioned above, respectively the recognition certificate issued by CNRED, if the document was obtained at other accredited foreign university institutions than those mentioned - copy and legalized translation (if applicable);
d) proof of the didactic position, issued by institutions of accredited higher education from member states of the European Union, the European Economic Area, the Swiss Confederation, and prestigious higher education institutions in other countries included in the List of prestigious universities from other countries, approved by ministerial order and updated periodically - copy and legalized translation (if applicable);
e) verification sheet of meeting the minimum requirements for occupying a didactic position in Romanian higher education in force at the date of submitting the recognition request and the provisions of Regulation R51, in case of requests submitted on the basis of Article 5.1.2.

Legalized translation is not required for persons who have obtained study diplomas from accredited university institutions from member states of the European Union, the European Economic Area, the Swiss Confederation.


The file can be submitted to the USV registry, sent by post, or through PCUe. The file is processed by SPADAC within 5 working days. If it is found that the file does not include the documents specified in the paragraph above, the applicant is notified in writing or by email for completion. The completion deadline is a maximum of 10 working days.
The complete file is transmitted to the recognition commission, which will evaluate and pronounce regarding the application. The decision will be recorded in a report signed by all commission members.

The decision of recognition / non-recognition of didactic positions in university education obtained in accredited foreign higher education institutions is issued by the USV Rector and is valid and produces legal effects at the USV level.

The recognition certificate will be drafted in two copies, one of which is sent to the applicant and one will be archived at SPADAC.

Appeal routes

The decision may be appealed once, within 10 days from notification, by submitting a motivated request at the USV registry, by mail, or via PCUe.

The results found by the appeals committee are recorded in a report which will be part of the recognition file and will be signed by all members of the appeals committee.

The duration for resolving the appeal is a maximum of 10 working days from the date of registration of the appeal. The resolution period stipulated in the previous paragraph may be extended in justified cases, with the applicant being informed in writing, by postal courier or email.

The solution of the appeals committee, recorded in a report, can be challenged in competent courts within the Suceava municipality.

Issuance of the recognition document

The recognition certificate is issued to the holder or to a person authorized by a notarial power of attorney. In case of loss, destruction, or deterioration of the issued recognition document, a duplicate may be issued upon request, after consulting the archive.
