EMITENT: MINISTERUL AGRICULTURII, PĂDURILOR ŞI DEZVOLTĂRII RURALE
PUBLICAT ÎN: MONITORUL OFICIAL nr. 377 din 3 mai 2006
Având în vedere prevederile art. 12 alin. (1) şi ale art. 51 din Legea îmbunătăţirilor funciare nr. 138/2004,
în temeiul art. 7 alin. (5) din Hotărârea Guvernului nr. 384/2004 privind organizarea şi funcţionarea Ministerului Agriculturii, Pădurilor şi Dezvoltării Rurale,
ministrul agriculturii, pădurilor şi dezvoltării rurale emite următorul ordin:
Art. 1. - Prevederile prezentului ordin se aplică pentru stabilirea amplasării şi dimensiunilor zonelor de protecţie adiacente infrastructurii de îmbunătăţiri funciare care deserveşte sistemele de irigaţii, de desecare şi drenaj, de combatere a eroziunii solului şi de ameliorare a terenurilor afectate de salinizare şi alcalizare.
Art. 2. - Zonele de protecţie adiacente infrastructurii de îmbunătăţiri funciare se stabilesc pentru a preveni deteriorarea şi pentru a asigura funcţionarea şi exploatarea normală a acesteia, cu respectarea cerinţelor de mediu, precum şi a celor specifice de siguranţă şi securitate.
Art. 3. - Amplasarea şi dimensiunile zonelor de protecţie adiacente infrastructurii de îmbunătăţiri funciare se vor stabili astfel:
a) pentru canalele de irigaţii, de desecare şi de drenaj, zona de protecţie are o lăţime de minimum 4 metri pe fiecare parte a canalului;
b) pentru staţiile de pompare şi alte construcţii hidroedilitare, zona de protecţie are o lăţime de minimum 5 metri pe conturul exterior al amplasamentului;
c) pentru digurile şi barajele care servesc la îmbunătăţiri funciare, zona de protecţie are o lăţime de minimum 2 metri pe fiecare parte a acestora;
d) pentru şanţurile şi alte lucrări de combatere a eroziunii solului şi ameliorare a terenurilor afectate de salinizare şi alcalizare, zona de protecţie are o lăţime de minimum 2 metri pe fiecare parte a lucrării.
Art. 4. - Fără a aduce atingere prevederilor art. 3, în situaţii deosebite, amplasarea şi dimensiunile zonelor de protecţie pot fi modificate prin avizul Ministerului Agriculturii, Pădurilor şi Dezvoltării Rurale, la solicitarea utilizatorului infrastructurii de îmbunătăţiri funciare.
Art. 5. - Prezentul ordin se publică în Monitorul Oficial al României, Partea I.
