The sale of agricultural land located in non-urban areas, without respecting the right of pre-emption or without obtaining the necessary approvals, is prohibited and sanctioned with absolute nullity.

Publicizing the sale offer of agricultural land located in non-urban areas - the person who wishes to sell must register, at the City Hall within whose administrative area the land is located, a request for the display of the sale offer of the respective area, to inform the pre-emptors. Within 5 working days from the date of registration of the request, the City Hall will display the sale offer, for 45 working days, at its headquarters. Also, within 10 days, the City Hall is required to notify the holders of the right of pre-emption regarding the registration of the sale offer. If the right of pre-emption is not exercised, potential buyers may submit to the City Hall a file containing the documents proving the fulfillment of the conditions, within 30 days from the expiration of the above-mentioned 45 working days period. If the right of pre-emption is not exercised and if none of the above potential buyers, within the legal term, fulfills the conditions to purchase the non-urban agricultural land, its alienation by sale may be made to any natural or legal person, under the conditions of the law.
