According to the provisions of art. 42, paragraph (4) of Law no. 448/2006 republished, with subsequent amendments and completions, "the parents or, as the case may be, the legal representatives of the child with severe disability, the person or family who has taken in a child with severe disability, adults with severe disability or their legal representatives, except for those with severe visual impairment, may choose between a personal assistant and receiving a monthly allowance."

The payment of the allowance is made for the period of validity of the certificate of classification in the severe degree of disability, issued by the child protection commissions or by the assessment commissions for adults with disabilities, as the case may be, and is ensured by the city halls in whose territorial area the person with disabilities has their domicile or residence.

The allowance is granted starting with the month following the submission of the application and ceases with the month following the one in which the person with disabilities no longer meets the conditions that led to the establishment of the right, according to the legal provisions in force.

In order to obtain the right to a monthly allowance, entitled persons shall submit the following documents:
