The approval required for the sale of agricultural land outside the built-up area can be requested by any person who owns agricultural land outside the built-up area, for the purpose of selling.
Posting the sale offer
Within one working day from the registration of the application, the sale offer will be posted for 30 days at the headquarters of the Negreşti City Hall and on the city hall's website.
Within 3 working days from the registration of the sale application, the Agricultural Registry Office will draw up the list of pre-emptors, which will be posted at the city hall's headquarters and on the website.
Acceptance of the sale offer
Within 30 days from the posting of the sale offer, the Public Relations Directorate will register all notifications of acceptance of the land sale offer (model ANNEX 1D), submitted by any of the pre-emptors, accompanied by the following documents:
- copy of ID/identity card for pre-emptor natural person;
- copy of the certificate of registration from the Trade Registry for pre-emptor legal entity;
- notarized copies of supporting documents certifying the status of pre-emptor (co-ownership documents, lease contract, ownership documents of properties with a common border with the land subject to sale, etc.)
Choosing the pre-emptor potential buyer
The seller's decision regarding the selection of the pre-emptor potential buyer will be registered at the Public Relations Office
Within 3 working days from its registration, the Agricultural Registry Office will communicate, as the case may be, to M.A.D.R. or D.A.D.R. MM the name and identification data of the selected pre-emptor, potential buyer.
The final approval required for concluding the sale contract in authentic form by the public notary is issued, as the case may be, by M.A.D.R. or D.A.D.R. MM.
Non-exercise of pre-emption right
If no pre-emptor communicates acceptance of the seller's offer and the sale is free, the Agricultural Registry Office will issue the seller a certificate attesting that all procedural steps regarding the exercise of the pre-emption right have been completed and that the land is free for sale, at the price specified in the sale offer. The certificate will be accompanied by a certified copy of the original sale offer.
