THE DEADLINE FOR DECLARING AND REGISTERING THE BIRTH

In the absence of agreement between the parents regarding the child’s surname, the guardianship court decides the child’s surname and communicates the final decision to the S.P.C.L.E.P./town hall of the administrative-territorial unit which registered the birth certificate; the birth certificate is issued only after entering the mention regarding the establishment of the surname by the guardianship authority; in a similar manner, if the civil status officer refused to register the given name and the parents do not want to choose another given name.
The given name declared at the date of birth registration cannot consist of more than three words.
When the birth declaration is made by a foreign citizen, not knowing Romanian language, or by a person with hearing or deafblindness, the necessary documents for registration are required through an authorised interpreter or, as the case may be, an authorised interpreter of sign language or the language specific to persons with deafblindness; the civil status officer/personnel with civil status responsibilities draws up a report.
In case the parents’ marriage was concluded abroad and not transcribed in the Romanian civil status registers, the civil status certificate issued by the foreign authorities is urgently transcribed in the Romanian civil status registers; the child’s birth is registered after the parents’ marriage is transcribed.
IF YOU DECLARED THE BIRTH AFTER THE LEGAL DEADLINES, NAMELY:
• 30 days for a live-born child,
• 3 days for a stillborn child;
• 24 hours from the date of death for a live-born child who died within the 30-day period, but within one year from birth, the birth certificate is issued with the approval of the mayor of the administrative-territorial unit in which the birth took place.
REGISTRATION OF BIRTH IF MORE THAN ONE YEAR HAS PASSED SINCE THE DATE OF BIRTH
After one year has passed from the date of birth, the birth certificate is issued:
• at the written request of the declarant;
• with the approval of the mayor of the administrative-territorial unit where the event occurred;
• with the approval of the County Community Public Service for Personal Records or, as the case may be, the General Directorate for Population Records of the Bucharest Municipality.
The application is filed at the civil status structure within any S.P.C.L.E.P. or at any town hall of the administrative-territorial unit.
In all cases where a female person, over 14 years old, requests late registration of her birth, she must make a statement before the civil status officer/personnel with civil status responsibilities indicating whether she has any child whose birth has been registered before her own birth registration.
Upon completion of the child’s birth certificate, the Romanian citizen child is assigned a personal numerical code which is entered on the issued birth certificate.
