MINIMUM INCLUSION INCOME

(According to Law no. 196/2016)

Information regarding the granting of minimum inclusion income (MII)

Legislative framework

– the provisions of Law no. 196/2016, regarding minimum inclusion income, with subsequent amendments and additions;

– the provisions of GEO no. 114/2022, for amending and supplementing Law no. 196/2016 regarding minimum inclusion income, with subsequent amendments and additions;

– the provisions of GD no. 1154/2022, for approving the Methodological Norms for applying the provisions of Law no. 196/2016 regarding minimum inclusion income, with subsequent amendments and additions;

Thus, the minimum inclusion income (MII) is established, which represents the financial support given by the state in order to ensure the minimum standard of living for families and single persons in difficulty, as well as to prevent the risk of poverty among children and to encourage their participation in the education system.

The minimum inclusion income consists of one or more of the following categories of financial aid:

a) inclusion aid;

b) aid for families with children.

Depending on the needs of the family/single person, the minimum inclusion income is accompanied by other complementary social assistance measures, granted in cash and/or in kind, as follows:

– incentives – special measures to stimulate participation in the labor market, granted in cash or representing deductions applied to the person's income;

– contributory facilities – access to the health social insurance system without paying the health social insurance contribution;

– other complementary rights – financial transfers and/or support in kind, to facilitate social inclusion and prevent the risk of social exclusion, granted to beneficiaries of minimum inclusion income or other categories in special situations, consisting, as appropriate, in:

(i) payment of the mandatory home insurance against earthquakes, landslides, and floods;

(ii) granting community and emergency aid intended to support the family/single person to overcome temporary difficulties and to prevent or reduce the risk of poverty and social exclusion;

(iii) access to financial support measures for promoting and sustaining attendance at educational courses, organized under the law by beneficiaries of the minimum inclusion income;

(iv) measures to encourage employment, as well as other measures to facilitate access for beneficiaries of minimum inclusion income to a job;

(v) access to available social services, depending on the identified needs to overcome situations of difficulty.

MII consists of all sums related to the financial aid provided by art.3 para.(2) of the law, which are established depending on the inclusion in the monthly adjusted income realized by the family within the following limits:

for inclusion aid, up to an adjusted net monthly income of 393 lei inclusive, which is taken into account when establishing the cumulative income of the family;

for the inclusion aid, up to an adjusted net monthly income of 572 lei inclusive, which is taken into account when establishing the income of the single person aged at least 65 years;

for the aid for the family with children, up to an adjusted net monthly income of 998 lei inclusive.

In this sense, new concepts have emerged, such as: equivalence coefficient (1 for the single person and for the legal representative of the family), family size (the sum of the equivalence coefficient corresponding to the family representative = 1 + 0.5 for each family member), and adjusted net monthly income (obtained by dividing the net total income of the family realized in the month prior to the application to the family size), for calculating the award threshold and the amounts granted as inclusion aid or aid for the family with children.

Granted sums

The amount granted monthly as inclusion aid will be maximum:

– 366 lei, for a single person without income;

– 533 lei, for a single person aged at least 65, without income;

– 549 lei, for a family composed of two persons (366 lei * 1.5 family size);

– 732 lei, for a family composed of three persons (366 lei * 2 family size);

– 915 lei, for a family composed of four persons (366 lei * 2.5 family size);

– 1098 lei, for a family composed of five persons (366 lei * 3 family size);

The amount granted as aid for families with children is determined according to the level of adjusted net monthly income and the number of children in the family, respectively:

1. For the family with adjusted net monthly income up to 366 lei/month, the monthly amount of aid for families with children is:

– 143 lei, for the family with one child;

– 286 lei, for the family with 2 children;

– 482 lei, for the family with 3 children;

– 570 lei, for the family with 4 or more children.

  1. For the single-parent family with adjusted net monthly income up to 366 lei/month, the monthly amount of aid for families with children is:
  2. – 161 lei, for the family with one child;
  3. – 320 lei, for the family with 2 children;
  4. – 479 lei, for the family with 3 children;
  5. – 638 lei, for the family with 4 or more children.
  6. For families with adjusted net monthly income between 367 lei/month and 930 lei inclusive, the monthly amount of aid for families with children is:
  7. – 115 lei, for the family with one child;
  8. – 228 lei, for the family with 2 children;
  9. – 341 lei, for the family with 3 children;
  10. – 452 lei, for the family with 4 or more children.
  11. For single-parent families with adjusted net monthly income between 366 lei/month and 930 lei inclusive, the monthly amount of aid for families with children is:
  12. – 148 lei, for the family with one child;
  13. – 287 lei, for the family with 2 children;
  14. – 432 lei, for the family with 3 children;
  15. – 572 lei, for the family with 4 or more children.

*If the calculation results in an amount less than 63 lei, then 63 lei is granted.

Clarifications:

For calculating the adjusted net monthly income, all amounts received/earned by the single person or by each family member in the month prior to the MII application are taken into account, except for the following income:

a. amounts received as social benefits under Law no. 448/2006 regarding the protection and promotion of the rights of persons with disabilities, republished, with subsequent amendments and additions;

b. the state allowance for children granted under Law no. 61/1993 regarding the state allowance for children, republished, with subsequent amendments;

c. amounts granted as scholarships or other forms of financial support intended exclusively for supporting the education of preschoolers, pupils, and students, through programs of the Ministry of National Education and Scientific Research, other public and private institutions, including non-governmental organizations;

d. amounts received from activity carried out as a day laborer, under Law no. 52/2011 regarding occasional activities performed by day laborers, republished, with subsequent amendments and additions, as well as those obtained as a domestic worker based on Law no.111/2022 regarding the regulation of domestic worker activities;

e. amounts received by able-bodied family members as a result of participation in professional training programs organized under the law, if these are not considered salary income;

f. amounts occasionally received from individuals or legal entities, as well as amounts as emergency aid received from the state or local budget;

g. educational incentive granted according to the provisions of Law no. 248/2015 regarding encouraging participation in preschool education for children from disadvantaged families, republished, as a social voucher for encouraging preschool attendance for children from disadvantaged families;

h. occasional amounts granted from the state or local budgets as compensation or financial support for exceptional situations;

i. aid for home heating and the energy supplement granted based on Law no. 226/2021, with subsequent amendments;

j. monthly food allowance granted under Law no.584/2002 regarding measures to prevent the spread of AIDS in Romania and protection of persons infected with HIV or sick with AIDS, with subsequent amendments and additions, and the monthly food allowance provided by Law no.302/2018 regarding tuberculosis control measures;

k. amounts received as support, provided from the state budget or non-reimbursable funds, granted under the law or based on approved operational programs.

The MVI consists of the total amounts related to the financial aids provided by art. 3 para. (2) of the law, which are determined based on the classification in the adjusted monthly income earned by the family within the following limits:

for inclusion aid, up to an adjusted net monthly income of 393 lei inclusive, which is taken into account when determining the family's cumulative income;

for inclusion aid, up to an adjusted net monthly income of 572 lei inclusive, which is taken into account when determining the income of a single person aged at least 65 years;

for aid for families with children, up to an adjusted net monthly income of 998 lei inclusive.

Other documents specific to the applicant’s/beneficiary’s situation: a. the contract regarding the ownership of the dwelling in which they live; b. utility bills; c. marriage certificate, as the case may be; d. court decision for granting/approval for adoption, according to the law; e. court decision or, as the case may be, the decision of the child protection committee for the placement measure, according to the law; f. court decision by which the temporary delegation of parental authority to the designated person is ordered, according to the provisions of art. 104 and art. 105 of Law no. 272/2004 regarding the protection and promotion of the rights of the child, republished, with subsequent amendments and completions; g. the general director’s decision of the general directorate of social assistance and child protection or, as the case may be, court decision for the emergency placement measure, according to the law; h. court decision for the establishment of guardianship or, as the case may be, the order of the guardianship authority, according to the law; i. supporting document attesting to the quality of legal representative of the minor lacking full civil rights exercise capacity, namely parent, guardian, curator, other person designated as legal representative by decision of the general director of the general directorate of social assistance and child protection or, as the case may be, by court decision; j. court decision by which the husband/wife is declared missing; k. court decision by which the husband/wife is preventively arrested for more than 30 days or is serving a custodial sentence and does not participate in the maintenance of the children; l. as the case may be, other supporting documents regarding family composition. The family composition, the children’s filiation, and their legal status in relation to the legal representative will be verified/validated by the staff of the Social Protection Service through onsite verification and/or through SNIAS.*

Goods that lead to VMI exclusion

The establishment of the right to minimum inclusion income is done taking into account the goods of the family or, as the case may be, of the single person, included in the List of goods that lead to the exclusion of granting the minimum inclusion income. The list can be consulted below.

LIST of goods that lead to the exclusion of granting the minimum inclusion income

A. Immovable goods

Buildings, other living spaces besides the domicile residence, as well as land located in urban areas with an area over 1,200 sq.m. and 2,500 sq.m. in the rural area, except for land surrounding the house and the related yard.

  1. Movable goods
  2. 1. More than one vehicle over 10 years old, registered for use on public roads;
  3. 2. Vehicle registered for use on public roads less than 10 years old, except those used and/or adapted for the transport of persons with disabilities;
  4. 3. Motorboats, motorboats, yachts, or other types of boats, except those necessary for transport in the case of persons living in the area of the "Danube Delta" Biosphere Reserve;

NOTE:

In the event that one or more goods owned by the single person/family benefiting from minimum inclusion income are rented/leased/concessioned, this asset will be taken into account for the person/family who rents/leases/concessions it, and for the rightful owner, the value obtained from transferring the right of use will be taken into account.

The person or family who, besides their home of residence, holds a share of another building/living space/real estate may benefit from minimum inclusion income regardless of the share size, if this possession cannot be exploited.

  1. Bank deposits
  2. At least one of the family members owns, as account holder, one or more bank accounts/deposits, whose total sum is more than 3 times the value of the average gross wage provided by the Law on State Social Insurance. (Currently the value is 6095*3=18285 lei)

Obligations of the beneficiary

The beneficiary of the minimum inclusion income is obliged to notify the town hall in whose territorial jurisdiction they have their domicile or residence, any change regarding domicile, income, and number of family members, within a maximum of 10 days from the date the change occurred.

Single persons and families receiving minimum inclusion income are required to submit to the town hall, every 6 months, a declaration on their own responsibility regarding any changes, accompanied by supporting documents, as the case may be.

Persons able to work who do not earn income based on an individual employment contract, service report, or other legal form of employment, nor from independent or agricultural activities, as defined by Law no.227/2015, as subsequently amended and supplemented, are required to report, whenever requested by the territorial employment agency at which they are registered as job seekers, for employment or participation in services for stimulating employment and professional training.

In the case of single persons and families benefiting from minimum inclusion income consisting exclusively of child support for the family, the above obligation does not apply.

In the case of families benefiting from minimum inclusion income that includes the inclusion aid component, one of the adult members able to work of that family is required to perform monthly, at the mayor's request, activities or work of local interest, respecting the normal duration of working time and health and safety regulations at work.

Exceptions are made for families for whom the amount of inclusion aid is up to 63 lei. For these, working hours are established quarterly and performed in any of the months of the quarter.
