According to art.50 of Law 273/2004 regarding the adoption procedure, "The adopter or, optionally, either spouse of the adoptive family, who obtains income subject to income tax, according to the provisions of Law no. 227/2015 on the Fiscal Code, with a period of accommodation of up to two years, which also includes the period of subsequent modifications and completions, from salary activities and those assimilated to them or, as the case may be, from independent activities, copyright or agricultural activities, hereinafter referred to as the entitled person, may benefit from a leave for the entrustment of the child for adoption, as well as a monthly allowance."

According to art.73 paragraph 3 of Government Decision 579/2016 regarding the approval of the Methodological Norms for the application of Law 273/2004 regarding the adoption procedure, "For the granting of the monthly allowance related to the accommodation leave, the application and the supporting documents provided for in paragraphs (1) and (2) shall be submitted within 10 working days from the date on which the court decision for entrustment for adoption was enforced and shall be registered at the county agency for payments and social inspection and, respectively, of the municipality of Bucharest, in whose administrative-territorial area the entitled person resides, hereinafter referred to as the territorial agency."
