Obtaining the location approval requested in the Urbanism Certificate, consists of going through the following steps:

1. Submitting the application and the related documentation, to the company's Territorial Operation (the competent authority is determined according to the location where the future construction will be executed-

Transitional: Until the full technical operationalization of the national platform, the transmission flow will be via email.

- Note: If the application is wrongly addressed, it will be redirected to the competent Territorial Operation for resolution.

MANDATORY DOCUMENTATION CONTENT:

1. Standard application
2. C.I. copy (natural persons) or as applicable registration certificate (legal persons)
3. Technical memo regarding the intended construction work
4. Copy of the Urbanism Certificate (within validity period)
5. Location plan for the area, scale 1:25,000 or 1:10,000;
6. Situation plan (pdf, DWG format), stereo 70 coordinates, scale 1:500, that must include the location of the constructions in the proposed perimeter, utility connections (if applicable), as well as the relevant access roads; The plan will also include a table with stereo 70 coordinates of the land border points

The beneficiary (applicant) acknowledges that NON-SUBMISSION of the documentation in the above-mentioned composition entails an extension of the resolution periods.

2. Registration of the application with the Territorial Operation.

3. Verification of documentation and request for additional information, if necessary;

If the documentation is not submitted in the above-mentioned composition/form, clarifications will be requested.

Clarifications will also be requested for the approval fee (when applicable)

The fees charged for issuing the location approval are posted on the Transgaz website

CLARIFICATION REQUEST DEADLINE - maximum 5 working days from the submission of the initial application.

RESPONSE DEADLINE to clarifications – the beneficiary is required to respond to the request for clarifications/completions, and pay the fee (when requested) within a maximum of 60 calendar days from the date of receiving the request for completion.

All clarifications/completions/paid fees must be sent in a single reply by email.

4. Communication of the fee corresponding to the type of approval requested; issuing the invoice and/or the receipt;

If the applicant does not express acceptance, and does not make the payment, the submitted application cannot be further processed, the application will be closed.

Failure to send the response to clarifications and/or non-payment of the fee in the requested form and by the imposed deadline leads to rejection of the application.

A REJECTION LETTER will be issued and sent to the applicant

5. Allocation of necessary resources and scheduling of the site visit; dispatch of the OTS technical team to and from the designated location for identification and onsite verification of the location for which the approval is requested; and of the ST objectives;

6. Preparation of an opinion on the documentation through marking the ST objectives on the site plan structure, specifying GPS coordinates and endorsing the site plan.

NOTE: After this stage, the entire documentation will be considered complete; A registration number will be assigned to the complete documentation.

7. The complete documentation will be reviewed and the location approval issued by the competent structure

• For works located outside the safety zone, the Territorial Operation reviews the entire documentation and issues the location approval.
• For works within the safety zone, the Territorial Operation will forward the complete documentation for analysis and approval to the Medias central office- D.E.M. – serv. A.C.P.C.,

8. RESOLUTION DEADLINE

• 15 days from registration of the initial application- when the initial documentation is complete and NO fee is charged.
• 15 days from the date of submission by the beneficiary of clarifications/completions/paid fee - when completions/clarifications/fee have been requested.

9. Sending the approval to the applicant.

LOCATION approvals are received scanned to the email specified in the application.

10. The approval may be favorable, conditional or unfavorable.

The following will be issued:

- a favorable approval, if when placing the future construction the minimum safety distances stipulated in Order A.N.R.E. no. 118/2013 regarding the approval of Technical rules for the design and execution of natural gas transmission pipelines are observed.

- an unfavorable approval, if when placing the future construction the minimum safety distances stipulated in Order A.N.R.E. no. 118/2013 regarding the approval of Technical rules for the design and execution of natural gas transmission pipelines are not observed. In the case of an unfavorable approval, the reasons that led to the prohibition of construction or works in the ST safety zone will be specified, as well as the way to obtain a favorable approval. (relocation of the construction or, if possible, deviation of SNT objectives, at one's own expense)

- a conditional approval, if minimum safety distances are respected, but the establishment of specific technical conditions is required, by which the applicant is informed to fulfill the technical conditions, at their own expense, prior to execution of the construction. Failure to meet these conditions renders the approval null and void.

11. Validity of the location approval

Approvals and agreements issued, requested through the urbanism certificate, including at the feasibility study phase or authorization documentation for intervention works, remain valid until acceptance upon work completion, if no new factors arise or there are no changes to the conditions that formed the basis for their issuance, respectively the technical solutions at the technical documentation stage for obtaining the building permit, until the completion of the relevant works for which they were issued, respectively until signing the corresponding final acceptance report.

12. Exemptions

The analysis and issuance of approvals/agreements for the approval of public works projects both for new constructions and interventions on existing constructions is done free of charge without analysis fees, consultancy fees or similar charges.
