Procedure regarding the issuance of the non-exclusive authorization-license for the public communication of commercial phonograms/phonograms published for commercial purposes and/or audiovisual performances (ambiental purpose) - Dec.99/2015*

According to art. 162 letter b) of Law no. 8/1996 regarding copyright and related rights, "collective management organizations have the following obligations: b) to grant non-exclusive authorizations to users, at their request, made before the use of the protected repertoire, in exchange for a remuneration, (...)".

For the public communication of phonograms and artistic performances in the audiovisual field (ambient purpose), legal entities and authorized individuals (PFA) have the obligation to conclude a non-exclusive license-authorization with CREDIDAM and to pay the remunerations due according to the methodologies in force (specifically ORDA decision no. 99/2015).

The users to whom this procedure applies are: commercial or service providing units, showrooms, duty-free shops, commercial galleries, malls, supermarkets, hypermarkets, hospitals, medical offices, treatment centers, casinos, internet rooms, game rooms, billiard halls, bowling, table tennis, beauty salons, and others assimilated - enclosed or open spaces located in cities, tourist resorts, communes and villages.

Procedure regarding the issuance of a non-exclusive license/authorization for the public communication of commercial phonograms/phonograms published for commercial purposes and/or artistic performances in the audiovisual field (for lucrative purposes) - Dec.10/2016.*

According to art. 162 letter b) of Law no. 8/1996 regarding copyright and related rights, "collective management organizations have the following obligations: b) to grant non-exclusive authorizations to users, upon their request, made before the use of the protected repertoire, in exchange for remuneration, (...)".

For the public communication of phonograms and artistic performances in the audiovisual field (for profit), legal entities and sole proprietorships are required to conclude non-exclusive license authorizations with the CREDIDAM Association and to pay the remunerations due according to the methodologies in force (specifically ORDA Decision no. 10/2016 amended by ORDA Decision no. 120/2016 and CAB decision of 15.03.2017), the fees being updated with the inflation index according to ORDA Decisions no. 60/2019, no. 6/2022, no. 35/2023, no. 35/2024. The users to whom this procedure applies are: show organizers, discotheques, DJs, gym/aerobics halls, etc.
