Procedure regarding the automatic recognition within Titu Maiorescu University of the status of doctoral supervisor or habilitation obtained in accredited higher education institutions from abroad*

PREAMBLE

1. This procedure describes the automatic recognition within Titu Maiorescu University of Bucharest (UTM) of the status of doctoral supervisor or habilitation obtained in accredited higher education institutions abroad, for affiliation to the doctoral schools within UTM.

2. The recognition of the status of doctoral supervisor or habilitation obtained in accredited higher education institutions abroad is carried out in accordance with the provisions of art. 216 para. (2) letter f) of the National Education Law no. 1/2011, with subsequent amendments and completions, Law no. 200/2004 regarding the recognition of diplomas and qualifications for regulated professions in Romania, with subsequent amendments and completions, the Code of University Doctoral Studies approved by the Government Decision no. 681/2011, with subsequent amendments and completions, the Methodology regarding the automatic recognition by higher education institutions, respectively institutions organizing university doctoral studies in Romania, of the status of doctoral supervisor obtained in accredited higher education institutions abroad, approved by OMENCS no. 5921/2016, the UTM Charter, and this Methodology.

GENERAL PROVISIONS

Art. 1.
The provisions of this procedure apply to Romanian citizens, citizens of Member States of the European Union and the European Economic Area, the Swiss Confederation, and citizens from third countries.
Art. 2.
UTM recognizes the status of doctoral supervisor or habilitation obtained in:
a) accredited higher education institutions from Member States of the European Union, the European Economic Area, and the Swiss Confederation;
b) prestigious universities from other countries, included in the List of prestigious universities from other states, approved by OMENCS no. 5825/201 and periodically updated.
Art. 3.
The status of doctoral supervisor or habilitation obtained at other accredited higher education institutions than those mentioned in art. 2 is recognized only based on international reciprocal recognition agreements, concluded at intergovernmental or inter-university level.
Art. 4.
UTM sets a fee for the evaluation of the file for recognition of the status of doctoral supervisor or habilitation through the Regulation regarding the List of Fees, approved annually by the Senate and the Board of Administration.
Art. 5.
The file for the recognition of the status of doctoral supervisor or habilitation obtained in higher education institutions from abroad is submitted directly by the applicant to the UTM Rectorate or through the Single Electronic Contact Point platform via the link https://edirect.e-guvernare.ro, with registration number.
Art. 6.
For the evaluation of requests for recognition of academic teaching positions from foreign higher education, the Rector appoints by decision an Evaluation Committee, consisting of 5 members: the vice-rector responsible for academic activity, as president, the UTM general secretary, the head of the Legal Office, and two tenured academic staff members at UTM, university associate professors or full professors in the applicant’s field or a related field.
Art. 7.
UTM may consult, if necessary, the National Center for Recognition and Equivalence of Diplomas (CNRED) and the National Council for Certification of Titles, Diplomas and University Certificates (CNATDCU) regarding the process of recognizing the status of doctoral supervisor or habilitation.
Art. 8.
(1) Recognition by UTM of the status of doctoral supervisor or habilitation is valid and produces legal effects only at the level of UTM.
(2) Recognition by CNRED of the status of doctoral supervisor or habilitation is valid and produces legal effects throughout the territory of Romania.

DESCRIPTION OF THE PROCEDURE FOR RECOGNITION OF THE STATUS OF DOCTORAL SUPERVISOR OR HABILITATION OBTAINED IN HIGHER EDUCATION INSTITUTIONS ABROAD

Art. 9.
(1) Within two working days from the date of registration, the Rectorate forwards the applicant’s file to the Evaluation Committee mentioned in art. 6.
(2) The Committee evaluates the application according to the following criteria:
a) whether the application falls into one of the categories mentioned in art. 2;
b) identification of the accredited higher education institution that issued the diploma/certificate attesting the status of doctoral supervisor or habilitation of the applicant. If the institution in question does not clearly belong to one of the institutions mentioned in art. 2, the recognition procedure ends, the applicant being directed by written notification to CNRED;c) examination of the apparent legality of the bachelor's degree, the doctorate degree, and the diploma/certificate attesting the status of doctoral supervisor or habilitation of the applicant. If there are suspicions from the members of the Evaluation Committee regarding the authenticity of these documents, the recognition procedure ends, the applicant being directed by written notification to CNRED;
Art. 10.
(1) The deadline for resolving the application by the Committee is 10 working days from the date of registration of the file.
(2) By exception to the provisions of para. (1), if during the evaluation of the file problems arise that require consultation of CNRED for resolution, the issuance of the decision by the Evaluation Committee is postponed until the issues are clarified.

FINAL PROVISIONS

Art. 14.
After the registration of the competition file, it remains in the UTM archive. Regardless of the evaluation result, the applicant cannot request the return of any pieces from the file. The evaluation fee of the file is not refundable under any circumstances.
Art. 15.
The UTM management, the Director of CSUD, the General Secretariat, the doctoral schools within UTM, as well as the Human Resources-Payroll Service shall implement the provisions of this Procedure.

Procedure regarding the recognition within Titu Maiorescu University of academic teaching positions obtained in accredited higher education institutions abroad*

PREAMBLE

1. This procedure describes the automatic recognition by Titu Maiorescu University in Bucharest (UTM) of academic teaching positions obtained in accredited foreign higher education institutions, for the purpose of occupying, for a determined period, certain vacant academic positions as visiting/associate teaching staff, as well as for participation in committees for competitions for occupying vacant teaching and research positions.

2. The recognition of teaching positions in higher education obtained in accredited foreign higher education institutions is carried out in accordance with the provisions of art. 216 para. (2) lit. f) of the National Education Law no. 1/2011, as subsequently amended and supplemented, of Law no. 200/2004 regarding the recognition of diplomas and qualifications for regulated professions in Romania, as subsequently amended and supplemented, of the Methodology on the automatic recognition of teaching positions in higher education obtained in accredited foreign higher education institutions, approved by OMENCS no. 5922/2016, the UTM Charter, and this Procedure.

GENERAL PROVISIONS

Art. 1.
The provisions of this procedure apply to Romanian citizens, citizens of member states of the European Union and the European Economic Area, the Swiss Confederation, and citizens of third countries.
Art. 2.
UTM recognizes the teaching positions in higher education obtained in:
a) accredited higher education institutions from European Union member states, the European Economic Area, and the Swiss Confederation;
b) prestigious universities from other countries, included in the List of prestigious universities from other countries, approved by OMENCS no. 5825/201 and periodically updated.
Art. 3.
Teaching positions obtained in other accredited higher education institutions besides those mentioned in art. 2 are recognized only on the basis of international mutual recognition agreements, concluded at inter-governmental or inter-university level.
Applicants who do not fall within one of the situations mentioned above must address themselves directly to the National Centre for Recognition and Equivalence of Diplomas within the Ministry of National Education (CNRED).
Art. 4.
The recognition of teaching positions according to this procedure does not entail the fulfillment of conditions/standards for permanent (open-ended) competitive occupation of teaching positions within UTM, as provided in the internal Methodology regarding the occupancy of vacant teaching and research positions.
Art. 5.
UTM establishes a fee for the evaluation of the recognition file of the academic teaching position from abroad, through the Regulation concerning the List of Fees, approved annually by the Senate and the Board of Administration.
Art. 6.
The file for the recognition of the teaching position from abroad is submitted directly by the applicant to the UTM Rectorate or on the One-Stop Shop Electronic Platform at https://edirect.e-guvernare.ro, with registration number.
Art. 7.
For the evaluation of requests for recognition of teaching positions from abroad, the Rector appoints by decree an Evaluation Committee composed of 5 members: the vice-rector responsible for teaching activity, as chair, the general secretary of UTM, the head of the Legal Office, and two tenured teaching staff at UTM, associate professors or professors in the applicant's field of expertise or in a related discipline.
Art. 8.
UTM may consult, if necessary, the National Centre for Recognition and Equivalence of Diplomas (CNRED) and the National Council for the Certification of University Titles, Diplomas, and Certificates (CNATDCU) regarding the process of recognition of teaching positions from abroad.
Art. 9.
(1) The recognition by UTM of foreign teaching positions in higher education is valid and produces legal effects only at the level of UTM.
(2) The recognition by CNRED of foreign teaching positions in higher education is valid and produces legal effects throughout the territory of Romania.

DESCRIPTION OF THE PROCEDURE FOR RECOGNITION OF TEACHING POSITIONS OBTAINED ABROAD

Art. 10.
(1) Within two working days from the date of registration, the Rectorate forwards the applicant's file to the Evaluation Committee mentioned in art. 7.
(2) The Committee evaluates the application according to the following criteria:
a) inclusion of the application in one of the categories mentioned in art. 2;
b) identification of the accredited higher education institution that issued the proof of the applicant’s teaching position. If the respective institution does not unequivocally belong to one of the institutions mentioned in art. 2, the recognition procedure is concluded, the applicant being directed by written notification to CNRED;
c) examination of the apparent legality of the bachelor's degree and the doctoral degree of the applicant. If the members of the Evaluation Committee have suspicions regarding the authenticity of the degrees, the recognition procedure is concluded, the applicant being directed by written notification to CNRED;
Art. 11.
(1) The deadline for resolving the application by the Committee is 10 working days from the date the file is registered.
(2) By way of exception to the provisions of para. (1), if during the evaluation of the file issues arise that require consultation with CNRED, the issuance of the Evaluation Committee's decision is postponed until these issues are clarified.

FINAL PROVISIONS

Art. 15.
After the competition file is registered, it remains in the UTM archive. Regardless of the evaluation result, the applicant cannot request the return of any item from the file. The evaluation fee is not refundable under any circumstances.
Art. 16.
The UTM management, General Secretariat, UTM faculties and their departments, as well as the Human Resources-Payroll Service, shall implement the provisions of the present Procedure.

Procedure regarding the automatic recognition within Titu Maiorescu University of Bucharest of the doctoral diploma and the title of doctor in sciences or in a professional field, obtained abroad*

This procedure describes the automatic recognition within Titu Maiorescu University of Bucharest (UTM) of the status of doctoral supervisor or habilitation obtained at accredited higher education institutions abroad, for affiliation to doctoral schools within UTM.
The provisions of this procedure establish the method by which Titu Maiorescu University of Bucharest automatically recognizes the doctoral diploma and the title of doctor in science or in a professional field, obtained abroad, in accordance with the provisions of Order MENCȘ no. 5923 of December 6, 2016 for the approval of the Methodology on the recognition of doctoral diplomas and the title of doctor in science or in a professional field, obtained abroad.
This procedure applies to holders of doctoral diplomas in science or in a professional field obtained at: a) accredited higher education or research-development institutions from a member state of the European Union, the European Economic Area, and the Swiss Confederation;
b) accredited higher education or research-development institutions included in the List of prestigious universities from other states, approved by order of the minister of national education and scientific research, periodically updated;
c) accredited higher education or research-development institutions that are the subject of an international mutual recognition convention concluded at intergovernmental or interuniversity level.

All applicants who do not fall under one of the situations mentioned above must address the National Centre for Recognition and Equivalence of Diplomas (CNRED) within the relevant ministry.

A candidate who wishes to request the University to recognize the doctoral diploma and the title of doctor in science obtained abroad must submit the relevant application file to the IOSUD UTM secretariat. The doctoral diploma must be authenticated with the Hague Apostille (if the issuing states are signatories to the Apostille Convention) and superlegalized or accompanied by a Certificate of Authentication issued by the competent authorities of the state which issued the diploma, if they are not signatories to the Hague Apostille Convention.
Titu Maiorescu University reserves the right to request the Ministry of National Education, respectively its specialized departments, for an opinion regarding the recognition of study documents submitted to the university. The recognition of the doctoral diploma and the title of doctor in science obtained abroad produces effects only within Titu Maiorescu University.
Recognition of the doctoral diploma and the title of doctor in science obtained abroad produces effects throughout Romania if it has been carried out by CNRED as a specialized body of the Ministry of National Education.

Processing the application file
The application file submitted by the candidate for the recognition of the doctoral diploma and the title of doctor in science obtained abroad is evaluated by CSUD. The processing time for the candidate's application file by Titu Maiorescu University is 30 working days, calculated from the date of its registration with all complete documents. The decision of recognition or non-recognition is issued following the final resolution pronounced by Senate Decision.
Appeals regarding the decision of non-recognition of the doctoral diploma and the title of doctor in science obtained abroad may be submitted within 5 working days from the date it is communicated to the candidate.
The response to the appeal submitted by the candidate regarding the decision of non-recognition of the doctoral diploma and the title of doctor in science obtained abroad will be communicated within 5 days from its submission, by IOSUD UTM.
