Change of legal representative for collecting the state allowance for children.*
The state allowance for children is paid to one of the parents based on their agreement or, in case of disagreement, based on the decision of the guardianship authority or the court decision, to the parent to whom the child has been entrusted for upbringing and education.
The modification of the legal representative for receiving the state allowance is done through a standard application addressed to the County Agency for Payments and Social Inspection Braila, accompanied by supporting documents, as the case may be:
- in case of the holder's death - the death certificate presented by the other parent, marriage certificate;
- in case of divorce - the court decision by which the minor/minors are entrusted to the applicant;
- in case of placement - a copy of the placement order issued by the General Directorate for Social Assistance and Child Protection, or the court decision establishing the placement or guardianship to the applicant.
- in case of adoption - the decision to entrust the child for adoption;
*Cessation of the insertion incentive when the holder no longer earns income*
The right to the insertion incentive ceases the day after the beneficiary no longer earns taxable income and the child has reached the age of 2, or 3 in the case of a child with disabilities. The right to the insertion incentive also ceases when the holder of the right benefits from maternity leave or maternal risk leave, these being non-taxable incomes according to Law 227/2015 regarding the fiscal code.
*Procedure for requesting uncollected amounts as state allowance for children.*
The submission and registration of the file for granting the child raising allowance*
By the 5th of each month, the town halls are obliged to send, based on a list, the requests registered in the previous month, accompanied by supporting documents, to the County Agency for Payments and Social Inspection.
The town halls will upload in the Necessary Documents section the List and Requests with the supporting documents.
*Transmission of documents for granting heating aid for the home with electric energy*
The list including the beneficiaries of the aid for home heating with electricity and its actual amount, to the County Agency for Payments and Social Inspection.
Sending documents for the granting of home heating aid with thermal energy*
By July 31, city halls are required to submit the Situation regarding the beneficiaries and the amount of aid for thermal energy, as well as the Centralized Summary Sheet including the beneficiaries of aid for thermal energy and its amount, to the County Agency for Payments and Social Inspection.
City halls will upload in the Necessary Documents section the Situation regarding the beneficiaries and the amount of aid for thermal energy and the Centralized Summary Sheet including the beneficiaries of aid for thermal energy and its amount, certified by the mayor, after receiving it from the thermal energy provider.
*Issuance of the certificate regarding the attestation of the period and the amount of the child-raising allowance.*
The holder of the child-raising allowance right may request the issuance of a certificate showing the period and amount of the allowance. This certificate is requested for the purpose of calculating unemployment benefits, medical leave, or for accessing bank loans, as applicable.
*Suspension of the child-raising allowance in the event of the beneficiary resuming professional activity*
The right to the child-rearing allowance until the child reaches the age of 2, or 3 years in the case of a child with a disability, is suspended starting the day after the beneficiary earns taxable income and the child has not yet reached the age of 2, or 3 in the case of a child with a disability.
The child-rearing allowance is suspended when the beneficiary resumes professional activity.
It is not suspended if the entitled person finds themselves in one or more of the following situations:
- receives various amounts based on the law, the collective labor agreement, or the individual labor contract, granted during the child-rearing leave, other than those resulting from actually performing an activity during the child-rearing leave;
- receives allowances as a local or county councilor, regardless of their amount;
- earns, in a calendar year, taxable income by actually performing an activity during the leave period, whose level does not exceed 5 times the minimum amount of the allowance, namely 6250 lei (1250 lei*5).
*Suspension of the insertion incentive when the holder no longer earns income*
The right to the insertion incentive is suspended starting the day after the beneficiary no longer earns taxable income and the child has not reached the age of 2, or 3 in the case of a child with a disability. The right can be resumed if the child has not reached the age of 2, or 3 in the case of a child with a disability, if the holder earns taxable income.

Until the 5th of each month, the town halls are required to submit, based on a cover sheet, the applications registered in the previous month, accompanied by supporting documents, to the County Agency for Payments and Social Inspection.
The town halls will upload the Cover Sheet and Applications with the supporting documents in the Necessary Documents section.
*Transmission and registration of the file for granting the child raising allowance and the state allowance for children*
By the 5th of each month, the town halls are required to submit, based on a register, the applications registered in the previous month, accompanied by supporting documents, to the County Agency for Payments and Social Inspection.
The town halls will upload in the Required Documents section the Register and the Applications with the supporting documents.
*Issuing the certificate for requesting the amounts remaining uncollected by the deceased person with disabilities*
Social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary personal budget for the month in which the death occurred, and, as the case may be, social benefits due and unpaid until death are paid to the surviving spouse, children, parents or, in their absence, to other heirs, under common law conditions, at their request. The amounts specified above can be requested from the territorial agency for payments and social inspection by the heir, within the general prescription period, based on the document attesting the status of heir and, in the case where there are several heirs, a statement on their own responsibility that the other heirs do not request these amounts.
*Submission of documents for granting home heating assistance with solid or petroleum fuels*
Until April 30, the town halls have the obligation to submit the Centralized Situation regarding the holders of home heating aid with solid or petroleum fuels, to the County Agency for Payments and Social Inspection.
The town halls will upload in the Required Documents section the Register and the Applications with supporting documents.
*Transmission of documents for granting home heating aid with natural gas*
By July 31, the town halls are required to submit the Centralized Situation regarding the holders of home heating allowances with natural gas, to the County Agency for Payments and Social Inspection, and the Statement including the beneficiaries of the home heating allowance with natural gas and its actual amount.
The town halls will upload in the Necessary Documents section the Centralized Situation regarding the holders of home heating allowances with natural gas and the Statement including the beneficiaries of the home heating allowance with natural gas and its actual amount, certified by the mayor, after receiving it from the natural gas supplier.
*Forwarding the file for granting the state allowance for children*
By the 5th of each month, the city halls are required to submit, based on a summary sheet, the requests registered in the previous month, accompanied by supporting documents, to the County Agency for Payments and Social Inspection.
The city halls will upload the Summary Sheet and Requests with supporting documents in the Required Documents section.
