Admission of the accommodation request in the “Dignitas Multifunctional Social Center”*

The beneficiaries of the social services provided in the “Dignitas Multifunctional Social Center” are:
adult male persons who have left the child protection system, do not have housing, and do not have the financial means necessary to rent or buy a home.
The conditions for access/admission to the center are as follows:
Persons wishing to benefit from the services of the “Dignitas Multifunctional Social Center” will submit an application at the headquarters of the Oradea Social Assistance Directorate, at the Public Relations and Initial Evaluation Service, Primăriei street, no. 42.
The application will contain personal data, method of contact, and will be attached with photocopies of the following documents:
a) Required documents:
- identity card;
- birth certificate;
- education documents;
- proof attesting to having been institutionalized (decision regarding termination of placement measure/certificate);
- and in original the following documents:
- certificate from the workplace;
- medical certificate indicating that they do not suffer from contagious diseases or serious mental illnesses;
b) Eligibility criteria:
Adult male from the child protection system
a) employed with a work contract, but income does not allow renting a home at market price,
b) unemployed
c) performs occasional work
d) has qualifications but is not employed
e) has no qualifications
c) Selection of beneficiaries
For the evaluation and selection of beneficiaries, a Commission is constituted by a decision of the Local Council, which analyzes requests for temporary accommodation in the center.
Applicants will be psychologically evaluated to identify aspects or problems specific to certain life situations the person is undergoing at that moment.
Based on the selection process, the commission will analyze the results obtained in the psychological evaluation and will interview potential beneficiaries;
Selection and admission of beneficiaries will take place throughout the year based on applications submitted to the Oradea Social Assistance Directorate, depending on the number of available places, and the Commission will meet quarterly, or as often as necessary.
d) Admission/rejection decision:
Following the interview, the Commission will decide on the admission or rejection of the accommodation request. If admitted, applicants will receive Admission Decisions to the Center issued by the Executive Director of the Oradea Social Assistance Directorate for a period of 1 year, with possibility of extension, and if the request is rejected, the applicant will receive a written response regarding the Commission's decision.
e) The contract for provision of social services is concluded by the Oradea Social Assistance Directorate for a period of 1 year with possibility of extension
f) The rental contract is concluded by the Oradea Real Estate Heritage Directorate within the Oradea City Hall, and the beneficiary will pay a monthly fee for the housing rent, the rate being established by the Oradea Local Council Decision.

Social investigation for the admission of the adult person with disabilities into a residential center*

The social inquiry is a method of investigation based on different techniques of collecting and processing information, for the purpose of analyzing the social and economic situation of individuals, families, groups, or communities.

The social inquiry is carried out by the specialized social service within the city hall in whose territorial jurisdiction the person with disabilities has their domicile or residence.

For carrying out the social inquiry, the applicant (as the case may be, their family, legal representative, personal assistant, the non-governmental organization of which the person with disabilities is a member or, in their absence, by any person representing them) shall submit, at the headquarters of the Oradea Social Assistance Directorate - Public Relations and Initial Evaluation Service, an application accompanied by the documents necessary for drawing up the social inquiry, after which an on-site verification at the patient’s home will follow.

Admission of beneficiaries to the Oradea Night Shelter*

Purpose of the operational procedure:

  • Establishes the manner of admission of beneficiaries to the Oradea Night Shelter as well as the persons involved in carrying out this activity;
  • Provides assurance regarding the existence of adequate documentation for conducting the activity;
  • Ensures continuity of the activity, including in conditions of staff fluctuation.

Scope of application of the operational procedure:

The activity of admitting beneficiaries to the Night Shelter is the process by which a person requesting social services becomes a beneficiary thereof. The admission activity is carried out in accordance with the provisions of the law and only if the Night Shelter can provide the minimum necessary services to meet the beneficiaries' needs. Beneficiaries and/or their legal representatives are aware of and accept the admission conditions.

State allowance for children*

All children up to the age of 18, as well as young people who have reached the age of 18 and who attend high school or vocational education courses organized according to the law, benefit from the state allowance for children until they complete their studies.

In the event that you also apply for the child raising allowance, it is no longer necessary to apply separately for the state allowance, as this benefit (state allowance) is requested simultaneously with the child raising allowance.

The integration/admission of children in the Day Care Center – DAS Oradea*

The mission of the “Oradea Day Care Center” service is to prevent the abandonment and institutionalization of children coming from families residing in the municipality of Oradea who are at social risk, by providing, during the day, care, education, recreation, socialization, counseling, the development of independent living skills, school and career guidance.
Beneficiaries of the services offered by the “Day Care Center” are:
- School-age children enrolled in mainstream education and the parents of children who receive benefits and services aimed at preventing their separation;
- Children who have benefited from a special protection measure and have been reintegrated into the family;
- Children who benefit from a special protection measure;
- Children whose parents benefit from a social protection measure;
- Children in situations of difficulty or at risk of social exclusion (coming from large, single-parent, disorganized families, with a low level of education), with possible risk of school and family abandonment.
Eligibility criteria for admission to the center:
- to be temporarily without income or to have low income, insufficient for self-support and for ensuring the daily necessities of life;
- there is a risk of institutionalization of the children;
- to be in a situation at risk of family and school abandonment;
- to be receiving social assistance;
- there is a situation of vulnerability / difficulty, for overcoming which support and assistance measures from the local community are needed (an obvious disproportion between the level of financial/material resources and the real needs of the family; severe medical situations in the beneficiary's family that affect the work capacity of their legal representatives; the possibility of aggravating family problems of a housing nature, etc.).

Granting social canteen*

Procedure Description

The services of the social assistance canteen are provided free of charge for persons who have no income or whose income is below the net monthly income level, for a single person, taken into account when determining social assistance.

Eligible persons to benefit from social assistance canteen services and who have incomes above the net monthly income level, for a single person, taken into account when determining social assistance, may benefit from the social assistance canteen services by paying a contribution of 30% of the income per person, without exceeding the cost of the meals served, calculated for the same period.

For the social services of the social assistance canteen, able-bodied persons in the family must perform 72 hours per month of actions or work of local interest, without exceeding the normal working schedule; failure to fulfill this obligation leads to the suspension of the right to social assistance canteen, and if within 3 months from suspension this obligation is not met, the provision of social assistance canteen ceases.

Beneficiaries

Children up to 18 years of age, coming from families benefiting from social assistance and from the social assistance canteen, in the care of those families whose average net monthly income per person is below the net monthly income level, for a single person, taken into account when determining social assistance and who provide proof of regular attendance at day courses of an educational institution.

Granting the right
Meals at the social assistance canteen are granted based on a request-declaration on one's own
responsibility, accompanied by supporting documents regarding the family composition, income achieved in the month prior to submitting the application by its members, and owned assets, including in other administrative-territorial units.

Social investigation for adults with disabilities for the purpose of ensuring recovery at home or in specially equipped centers*

The social investigation is a method of inquiry based on various techniques of collecting and processing information, for the purpose of analyzing the social and economic situation of individuals, families, groups, or communities.

The social investigation is carried out by the specialized social service within the town hall in whose territorial area the person with disabilities has their domicile or residence.

For conducting the social investigation, the applicant (as appropriate, their family, legal representative, personal assistant, the non-governmental organization of which the person with disabilities is a member, or, in their absence, by any person representing them) shall submit, at the headquarters of the Oradea Social Assistance Directorate – Public Relations and Initial Assessment Service, an application accompanied by the necessary documents for completing the social investigation, after which a field verification will be conducted at the patient's domicile.

Social voucher on electronic support for purchasing food products/hot meals for homeless people*

Emergency Ordinance 63/2022 aims to introduce temporary measures, consisting of the provision, until 31.12.2023, of material support for certain categories of vulnerable persons, as provided in this ordinance.

The material support for categories of vulnerable persons is intended to compensate part of the food expenses for ensuring daily subsistence, by granting social vouchers on electronic support, for the purchase of food products or provision of hot meals, with the aim of protection against the risk of material deprivation and the risk of extreme poverty.

Categories of beneficiaries

1. Pensioners of the public pension system registered with the pension offices

2. Persons – children and adults – classified with severe, accentuated, or medium handicap whose incomes are less than or equal to 1500 lei.

3. Families with at least two dependent children whose monthly net income per family member is less than or equal to 600 lei.

4. Single-parent families whose monthly net income per family member is less than or equal to 600 lei.

5. Families who have established the right to social assistance, under the conditions of Law 416/2001.

6. Homeless persons as regulated by the legal provisions in force.

Granting the electronic social voucher
The electronic social voucher for food/hot meal for homeless persons is granted based on a request-declaration on own responsibility, accompanied by a copy of the identity document and supporting documents regarding income earned from occasional work in the month preceding the submission of the request.

Based on the requests and statements on own responsibility submitted, the town hall draws up a centralized list of the persons meeting the support granting conditions.

The centralized list is sent in electronic format by the 5th day of the month to the County Agency for Payments and Social Inspection, which centralizes the situations at county level within a maximum of two days and sends them to the National Agency for Payments and Social Inspection at the national level.

Granting the monthly allowance to persons with severe disabilities*

The Oradea Social Assistance Directorate grants monthly allowances to persons with severe disabilities, based on certificates of classification in the degree of severe disability with a personal assistant.

The person with severe disabilities benefits from a monthly allowance, which is equal to the net salary of the personal assistant grade 0, established according to the legal provisions regulating the salary level of staff paid from public funds. The payment of the monthly allowance is for a fixed or indefinite period, depending on the validity period of the certificate of classification in the degree of disability.

The payment of the monthly allowance is ensured by the city halls in whose territorial area the person with severe disabilities has their domicile or residence.

The payment of the monthly allowance is made during the validity period of the certificate of classification in the degree of disability, issued by the commissions for child protection or the commissions for the assessment of adults with disabilities.

The parents or legal representatives of the child with severe disabilities, adults with severe disabilities or their legal representatives, can choose between a personal assistant and receiving a monthly allowance.

The choice is expressed through a written request.

The monthly allowance is granted starting from the month following the submission of the request, based on the decision of the executive director, and the payment is made during the validity period of the certificate of classification in the degree of disability.

For granting the monthly allowance, the applicant / legal representative / proxy / parent will submit to the headquarters of the Oradea Social Assistance Directorate - Public Relations and Initial Assessment Service, a request accompanied by supporting documents showing that the person classified in the degree of disability can benefit from the monthly allowance. The specialized service within DAS Oradea checks the submitted documents and will prepare the report and the decision regarding the granting of the monthly allowance.

Hiring a personal assistant for a person with severe disability*

Oradea Social Assistance Directorate is hiring personal assistants for persons/children with severe disabilities within the municipality of Oradea.
The personal assistant is the person who carries out their activity based on the individual employment contract concluded with the local public administration authorities in the area where the assisted person resides, and whose social environment, not adapted to their physical, sensory, or mental deficiencies, totally prevents or limits their access.
Depending on the validity period of the certificate classifying the assisted person as having a disability, the employment contract will be concluded for a determined or undetermined period. The contractual clauses comply with the provisions of the labor code and the current legislation.
The personal assistant is remunerated based on the individual employment contract concluded for a determined or undetermined period.
For the granting of the monthly allowance, the applicant/parent must submit at the headquarters of the Oradea Social Assistance Directorate - Public Relations and Initial Evaluation Service, an application, as well as supporting documents proving that the person with severe disabilities can benefit from the employment of a personal assistant.
The application is approved by the management of the institution, depending on the organizational chart and the status of approved positions of DAS Oradea, respectively the occupied positions.

Granting leave and monthly allowance for child raising/insertion incentive*

The allowance for raising children up to the age of 2, or 3 years in the case of a child with a disability, is a form of support to which are entitled those persons who, in the last 24 months prior to the child’s birth, have earned income for at least 12 months from salaries, income from independent activities, income from agricultural activities subject to income tax according to the provisions of Law no. 571/2003 regarding the Fiscal Code, as subsequently amended and completed – income subject to tax, or have been in one or more of the situations, called equivalent periods. This right can be granted to either of the biological parents of the child, as well as to the person who has adopted a child, provided that the eligibility criteria are met.

Persons who, during the period they are entitled to childcare leave, obtain income subject to taxation are entitled to an integration incentive.

Granting emergency aid*

The granting of emergency aid from the local budget of Oradea municipality in accordance with the provisions of Law no. 196/2016 regarding the minimum inclusion income with its subsequent amendments and completions and with the Decision of the Local Council no. 1240/21.12.2023, regarding the approval of the methodology for granting emergency aid, to single persons/families in situations of hardship and for the prevention or reduction of the risk of poverty and social exclusion, who have their domicile in the municipality of Oradea.

The Mayor may order the granting of emergency aid, in cash or in kind, to families or persons who are in situations of need arising as a result of natural disasters, fires, accidents, epidemics, epizootics, as well as in other special situations that may lead to the occurrence or increase of the risk of social exclusion, as established by local council decision.

Beneficiaries

Emergency aid is granted only once a year upon the written request of the single person, the family representative or the entitled person, according to the Application-declaration on own responsibility for requesting emergency aid (Annex no. 12 of Government Decision no. 1154/2022 for the approval of the Methodological Norms for the application of the provisions of Law no. 196/2016 with the subsequent amendments and completions).

Granting the right

Following the written request of a family member or the single person registered with DAS Oradea, two counselors from the Social Service verify on-site the socio-economic and housing situation declared by the applicant and draw up the On-Site Verification Sheet.

The data mentioned in the application and the declaration on own responsibility as well as in the supporting documents regarding the family composition and its income are entered into the computer application.

The case is presented by the secretary of the Commission for the analysis and the proposal for the granting of emergency aid, and the commission members decide the granting/non-granting and the amount of the aid. Subsequently, the documentation for the payment of the aid is prepared by the Economic-Financial and Administrative Service.

Based on the Order of the Mayor of Oradea municipality, the Payroll is drawn up, and the specialized service within DAS Oradea will make the payment of the emergency aid. The applicant for emergency aid will collect this benefit on the basis of presenting the original identity document.

The social investigation is a method of inquiry based on various techniques for collecting and processing information, for the purpose of analyzing the social and economic situation of individuals, families, groups, or communities.

The social investigation is carried out by the specialized social service within the town hall in whose territorial area the person with a disability has his or her domicile or residence.

To carry out the social investigation, the applicant (as the case may be, his or her family, legal representative, personal assistant, the non-governmental organization of which the applicant is a member, or, in their absence, any person who represents him or her) shall submit to the headquarters of the Oradea Social Assistance Directorate - Public Relations and Initial Evaluation Service, an application accompanied by the documents necessary for conducting the social investigation, after which the verification will be carried out on site at the residence of the patient.

Documents and papers required for preparing the social housing file*

Social housing is allocated with subsidized rent to individuals or families whose economic situation does not allow them to own a home or rent a home under market conditions.

Access to social housing for rent is granted to families or individuals with a net monthly income per person achieved in the last 12 months below the average net monthly salary on the whole economy, as communicated by the National Institute of Statistics in the latest Statistical Bulletin prior to the month in which the application is analyzed, as well as prior to the month in which the housing is allocated.

Social housing is allocated by local public administration authorities (Local Councils) based on criteria established annually by them.

Admission of beneficiaries in the Gutenberg Oradea Community Center*

The beneficiaries of the social services provided by the Gutenberg Community Center are:
  • homeless people
  • people over 18 years old in situations of social risk
Conditions for accessing the services:

Persons wishing to benefit from social services must submit an application at the center's headquarters in Oradea, Johann Gutenberg St., no. 8, and attach a copy of their identity document. Applications will be analyzed and approved by the center manager, in accordance with the eligibility criteria.

In situations where persons do not have identity documents, community services may also be provided without evaluation, it being sufficient to register the persons in the tracking register or presence lists.

Eligibility criteria for beneficiaries:

  • to be homeless persons,
  • to be persons over 18 years old, in situations of social risk

Conditions for terminating the social services provided by the Gutenberg Community Center:

  • repeated failure by the beneficiary of social services to comply with the regulations of the center (R.O.F.) of the social service provider;
  • if the beneficiary exhibits inappropriate behavior which makes counseling at the center incompatible under safe conditions for himself, the other beneficiaries or the center staff;
  • upon beneficiary's request;
  • in case of the beneficiary's death;
  • force majeure.

The integration/admission of children in the Day Center for children from marginalized communities in Oradea Municipality – DAS Oradea*

The mission of the service "Day Center for children from marginalized communities in Oradea Municipality" is to improve the living standard in the disadvantaged area of Gutenberg in Oradea and reduce trends of social and economic decline, to prevent the abandonment and institutionalization of children by providing, during the day, care, education, recreation, socialization, counseling, development of independent living skills, school and vocational guidance activities, as well as support and counseling activities for parents or legal representatives.

The beneficiaries of the social services provided within the "Day Center for children from marginalized communities in Oradea Municipality" are:
- Children aged between 3 and 18 years, school-age children being enrolled in mainstream education, and parents of children who are granted benefits and services destined to prevent their separation;
- Children who have benefited from a special protection measure and have been reintegrated into their family;
- Children who benefit from a special protection measure;
- Children whose parents benefit from a social protection measure;
- Children in a situation of risk (from large, single-parent, disorganized families, with a low level of culture and education), where school and family abandonment is possible;
- Other categories of people with similar situations proposed by the committee.
Eligibility criteria for admission to the center:
- to be temporarily without income or to earn low income, insufficient to sustain themselves and to provide for their daily living needs;
- there must be a risk of institutionalization of the children;
- to be at risk of family and school abandonment;
- to be social assistance beneficiaries;
- there must be a situation of vulnerability/difficulty, to overcome which support and assistance measures from the local community are needed (an obvious disproportion between the level of financial/material resources and the real needs of the family; serious medical situations in the beneficiary’s family that affect the working capacity of their legal representatives; the possibility of aggravation of family problems of a housing nature, etc.).

Social inquiry for school and professional guidance and minors with disabilities*

For the evaluation, psycho-educational assistance, school guidance, and professional guidance of children, students, and young people with special educational needs (SEN), the service for school and professional evaluation and guidance (SEOSP) was established within the county resource and educational assistance centers.
School and professional guidance is carried out by the School and Professional Guidance Commission (COSP), by issuing a certificate of expertise and school and professional guidance through which the child will benefit from education, according to specific needs.
School and professional guidance by COSP aims, on the one hand, at enrolling the child with disabilities and SEN or only with SEN in special and integrated special education, and on the other hand, schooling at home or in the hospital of children without SEN, non-mobile, for medical reasons. Non-mobile children for medical reasons may or may not have SEN and may also have or not have disabilities;
For the evaluation of children with disabilities, the Child Protection Commission (CPC) was established, as well as the Complex Child Evaluation Service (SEC) within the General Directorate of Social Assistance and Child Protection (DGASPC).
Evaluation is carried out in several segments, namely medical, psychological, educational, and social.
Social evaluation involves investigating the development environment of the child/student/young person. It is carried out by the public social assistance services within the town halls of the child’s domicile area and is materialized by drawing up the social investigation report.
DAS Oradea, through the responsible persons within the Child Protection Service, carries out social evaluation for the purpose of school/professional guidance of the child/student/young person with special educational needs (SEN) as well as for determining the degree of disability for children with disabilities.

Volunteer recruitment at the Oradea Community Unified Volunteer Center (CUVCO)*

Volunteering is conducted based on a contract concluded in written form, in Romanian, between the volunteer and the host organization. The obligation to conclude the volunteering contract in written form rests with the host organization. The written form is mandatory for the valid conclusion of the contract.

Providing material support - social vouchers on electronic support for food products and hot meals*

According to Decision No. 70 of January 31, 2024 for the approval of the mechanism for implementing measures to provide material support for certain categories of disadvantaged people, in the period 2024-2027, the rules of granting, the modality and frequency of support measures, as well as the responsible institutions in 2024, the material support-social vouchers on electronic support for food products and hot meals, have a nominal value of 250 lei and are granted once every two months to the following categories of disadvantaged people:

· families with at least 2 dependent children whose monthly income per family member is less than or equal to 675 lei;

· single-parent families whose monthly income per family member is less than or equal to 675 lei;

Families with children who do not benefit from assistance for families with children (VMI branch) can request the granting of the material support provided by this decision, if they meet the conditions, by submitting by the family member who has full exercise capacity and who requests, in the name of the family, the granting of the support measure a request and a declaration on their own responsibility.

Granting material support - social vouchers on electronic support for newborns*

Women who are part of a vulnerable category and who have given birth starting from April 12, 2024, can benefit from social vouchers worth 2,000 lei, which can be used to purchase products intended for newborn care.
The maximum age of three months of the newborn is verified at the time of identifying the mother/newborn couple by the Oradea Social Assistance Directorate and including them in the specific lists. The Oradea Social Assistance Directorate identifies, compiles, and assumes, through the signature of the legal representative, the lists of final recipients, with a separate distinction for the category of final recipients.
The following categories of persons are considered eligible and may benefit, upon request, from the social vouchers on electronic support:
- Mothers who benefit from the minimum inclusion income;
- Mothers with disabilities;
- Mothers in critical situations (disasters, domestic violence, etc.);
- Mothers without identification documents;
- Minor mothers;
- Mothers who are foreign citizens or stateless persons from conflict zones.
The social voucher on electronic support for newborns can only be used on the territory of Romania, within its validity period, and solely for purchasing newborn care products for which it was issued. Newborn care products refer to specific items for the newborn's layette, necessary for newborn care, namely: diapers, products for newborn hygiene, clothing items for the newborn, sanitary and medical items for the mother/newborn couple.

Granting heating aid and supplement for energy*

The heating aid for housing and the energy supplement are part of the category of social benefits granted by the Oradea Social Assistance Directorate.

Content and Role of Documents

Content of the documents – personal data, data regarding the incomes obtained by applicants and information regarding the assets owned;

Role of the documents – they form the basis for establishing or denying the right to heating aid/energy supplement, for the modification or termination of these benefits; the rights are established by issuing the mayor's order.

Document Flow

- Documents underlying the granting of aid: Applications and self-declarations accompanied by supporting documents regarding the family composition and the income obtained by its members are registered by the applicants at the DAS Oradea headquarters - Public Relations and Initial Evaluation Service and at the Multifunctional Social Centers in the city neighborhoods; data is processed in an IT program; at the end of the granting period (November – October) an archive is created;

- Documents for institutional use: Counselor - Head of Service - Executive Director - Mayor of Oradea Municipality - Thermal/gas/electricity supplier – AJPIS Bihor/other institutions.

Applicants for the heating aid/energy supplement submit individually or through owner/tenant associations the applications and self-declarations accompanied by supporting documents regarding the family composition and the income obtained by the members at the DAS Oradea headquarters – Public Relations and Initial Evaluation Service and at the Multifunctional Social Centers in the city neighborhoods.

Monthly, the counselors with responsibilities process in the software program the newly registered requests/changes/cessations of rights for the period between the 21st of the month and the 20th of the next month; verify the truthfulness of the declared data, establish rights, draw up reports and orders, generate centralized lists with the beneficiaries and transmit them to energy suppliers and AJPIS Bihor; draw up Statistical Reports and send them to AJPIS Bihor; verify the payroll lists including beneficiaries sent by suppliers, forward them for certification and send them to AJPIS Bihor for settlement; draw up Payrolls for beneficiaries of aid/supplement for energy with solid and/or liquid fuels.

Conduct of Operations and Activities

- documentation regarding the legislative provisions in the field of heating aid/energy supplement – counselors with responsibilities within the Social Service;

- materials/supplies necessary for the proper conduct of the activity are requested from the Economic-Financial and Administrative Service within DAS Oradea by means of a requisition/report;

- printing of Application/Self-Declaration forms regarding changes/Field Check Sheet in collaboration with Oradea City Hall, based on an internal note/requisition to the Directorate for monitoring operating expenses and organizing events;

- a written request is made to the Economic Directorate within the City Hall of Oradea and to the thermal energy supplier for communicating the local billing price to the population for thermal energy;

- intent notices are sent to institutions holding databases for the conclusion of protocols/additional acts for monthly verification, throughout the benefit period (November – October), regarding income (salaries, allowances, pensions)/movable and immovable property of benefit applicants;

- the List of goods that lead to exclusion from benefit, the Index of necessary documents to be attached to applications, the Income ranges for each of the 4 types of aid will be displayed electronically on the institution's website and will also be available on paper; these documents will also be provided to Owners' Associations and in electronic format via email communication with the support of the Owners' Associations Guidance and Control Office within Oradea City Hall;

- the conditions for granting heating aid/energy supplement, as well as other information related to these benefits, will be made public in the local press through press releases;

- applicants will fill in the application and declaration accompanied by supporting documents regarding family composition, realized incomes as well as proof of living space, and will submit them individually to the Public Relations and Initial Evaluation Service, to the Multifunctional Social Centers in the city neighborhoods or send them online;

- self-declaration applications are submitted until the 20th of each month in order to receive aid starting with the current month (e.g. – until November 20), and after the 20th of the month to benefit starting with the following month.

- The counselor, with permanent or temporary duties, verifies the correspondence between the data filled in the application and the supporting documents attached. For incomplete applications, the applicant will be informed, in writing (and verbally – by phone) through an invitation regarding the inconsistencies identified.

- The counselor writes his readable name, date and signature, records the application in the special register/software (only complete applications will be registered), each application having a distinct number containing the following elements: applicant's name and surname, supplier code, address, signature of the person submitting the application;

- A registration number from the special (electronic) register will be issued for each application submitted/type of heating – number under which the applications will also be archived;

- Complete and registered applications for granting heating aid/energy supplement with: thermal energy, electricity, solid or petroleum fuels as well as natural gas will be processed in the software program, being allocated a distinct number from the institution's CID program, forming the database for establishing the granting/denial of benefits. If there are suspicions regarding the veracity of the information declared by the applicant, field checks may be conducted (Field Check Sheet); if the applicant/beneficiary is not found at home, a Statement of findings is drawn up and an invitation is left in the mailbox in order to establish the possibility of conducting the visit and completing the Field Check Sheet;

- Within 15 working days from the registration date of the application for home heating with electricity, a field check is carried out (Field Check Sheet), a necessary and essential part, after which the data from the applications are processed in the program, and the granting/denial of benefits is established;

- Monthly, the movable and immovable assets of the applicants/beneficiaries of heating aid/energy supplement are checked by overlapping the database with the existing situation recorded by the Economic Directorate of Oradea City Hall as well as with the records of the Civil Status Service regarding deceased persons; also, on a monthly basis, based on concluded collaboration protocols, information is requested regarding the incomes of applicants/beneficiaries from A.J.P.I.S., A.J.O.F.M., C.J.P., etc. as well as, by internal note, the situation regarding personal assistants and allowances granted through DAS Oradea;

- Establishing the granting/denial, modification/cessation of heating aid/energy supplement is performed by order of the mayor, which is communicated to the holders, A.J.P.I.S. and suppliers within 5 days from the date of issuance; the calculation of the maximum aid in the case of heating aid with thermal energy is performed taking into account the average consumption set for the temperate zone and the local price per gigacalorie;

- Holders of heating aids are obliged to communicate any modification in the composition and income of the family, within 5 days from the date of the change, by submitting the Self-Declaration form regarding changes in the family composition and/or income, accompanied by supporting documents;

- Modifications or, as the case may be, cessation of the right to heating aid are made starting with the month following the one in which the change occurred;

- In case of changes, new orders regarding the modification of the aid will be issued.;

- At the beginning of the cold season, the payment method of the heating aid with solid fuels is established by order of the mayor;

- Monthly, after establishing the right to heating aid, the Centralized Reports for all types of aid/energy supplement are drawn up, containing: name, surname, supplier code, amount and percentage of aid, which are communicated to: suppliers and A.J.P.I.S.;

- Suppliers of thermal energy, electricity and natural gas send, based on the centralized report, payrolls to the owners’ associations; Owners’ associations have the obligation to send to the suppliers of thermal energy, electricity or natural gas the itemized consumptions;

- Based on the protocols, suppliers of thermal energy, electricity or gas calculate the actual aid and send the situation to DAS Oradea for certification by the mayor; the verified and certified reports constitute payment documents and are sent to A.J.P.I.S. Bihor for transferring the amounts into ESCROW accounts of the suppliers; one copy is sent back (electronically and/or printed) to the suppliers;

- Based on the monthly Centralized Report including the beneficiaries of heating aid/energy supplement with solid fuels sent to A.J.P.I.S. Bihor and according to the Decision on the method of payment of the benefits, DAS Oradea requests the necessary sums for the payment of benefits through the Economic-Financial and Administrative Service; the situation of heating aids/energy supplement with solid fuels is communicated monthly, by internal note, to the Economic-Financial and Administrative Service, which will make the payments based on the Payroll; if, at the end of the cold season, beneficiaries who have not collected their financial rights remain, Payrolls are drawn up, based on a written request from the beneficiary;

- The period during which heating aid with solid fuels will be paid will be communicated through mass media and by sms;

- Monthly, Statistical Reports are drawn up, including the beneficiaries of heating aid/energy supplement (numerically) distinctly for each type of aid (electricity, thermal energy, natural gas, solid fuels) and are sent to A.J.P.I.S. Bihor;

- In case it is found that the aid was granted unduly, it ceases starting with the following month and the mayor's order is issued in order to recover the sums granted as heating aid/energy supplement; the mayor's orders establishing debts are sent to A.J.P.I.S. Bihor in order to issue the Executive Director's Decisions regarding the recovery of unduly granted amounts;

- Resolved applications accompanied by supporting documents are archived in the order of the registration numbers in the special registers/software.

Beneficiaries

Heating aid and energy supplement are granted to families and single persons with low incomes to cover all or, as the case may be, part of the expenses for heating the home during the cold season November – March and to ensure all or, where appropriate, part of the expenses for home lighting, facilitating cooking and providing hot water in the home, ensuring continuity of electricity supply for equipment on which the life of persons depends, for health reasons, and the use of communication means requiring energy, for the period November - October.

Granting the Right

Families and single persons with low incomes who use central heating supplied thermal energy benefit from aid by percentage compensation of the actual thermal energy bill. Vulnerable consumers who use natural gas, solid or petroleum fuels or electricity for home heating benefit monthly, depending on the average net monthly income per family member, of an amount established by law. The energy supplement is granted in a fixed amount, depending on the sources of energy supply used. The funds needed for the payment of heating aid are provided from the state budget, through the budget of the Ministry of Labor and Social Solidarity.

Granting the minimum inclusion income - MII*

The minimum inclusion income represents the monthly financial support granted by the state in order to ensure the minimum standard of living, for single persons or families with legal residence in Romania, if the net monthly income of the single person or family is lower than the guaranteed minimum income.

The payment of the minimum inclusion income is ensured by the Bihor County Agency for Social Payments and Inspection, from the budget of the Ministry of Labor and Social Solidarity.

For the amounts granted as minimum inclusion income, one of the adult family members able to work must perform monthly actions or works of local interest, for all family members, without exceeding the normal work schedule; failure to fulfill this obligation leads to the suspension of the minimum inclusion income, and if this obligation is not fulfilled within 3 months from the suspension, the payment of the minimum inclusion income ceases.

Case management elderly persons*

This procedure regulates the way in which the Social Assistance Directorate collaborates with licensed social services for elderly persons operating within the municipality of Oradea, and by exception with social services from other administrative-territorial units that host beneficiaries residing in the municipality of Oradea.

Through case management, the social worker within the public social assistance service (SPAS) ensures the coordination of interventions from different fields for the integrated realization of needs and resources assessment, planning and intervention, monitoring and evaluation of the impact of community services provided to elderly people, with a view to implementing the principle of person-centered care.

Case management is ensured in collaboration, by the social worker within the Social Assistance Directorate and by the social worker/other designated specialist, from the social service provider/social service.

Beneficiaries - eligibility criteria

According to the legislation in force, elderly persons are considered persons who have reached the retirement age established by law.

According to Law no. 17/2000, republished with subsequent amendments and completions, the provisions of this procedure apply to: the elderly person, as defined in art. 1 paragraph (4), meaning the person who has reached the standard retirement age established by law and who is in one of the following situations:

a) has no family or is not supported by a person or persons legally obliged to do so, according to legal provisions in force;

b) has no housing and no possibility to provide housing conditions based on own resources;

c) does not earn own income or such income is not sufficient to provide the needed care;

d) cannot manage on their own or requires specialized care;

e) is unable to provide for their socio-medical needs, due to illness or physical or mental condition.

The Social Assistance Directorate identifies a case through at least one of the following forms:

a) the elderly person's phone;

b) the request of the elderly person/their legal representatives submitted to SPAS/FSS for social services or for minimum social inclusion income;

c) notification received from an FSS regarding:

- signing a contract for social services for the provision of social services to the elderly person;

- suspension of services for a determined period;

- termination of services provision.

d) referral by the community medical assistant, from another public service or a private organization;

e) self-referral;

f) notification from informal caregivers.

Procedure for appointingthe case manager/case responsible:

The appointment order for (CM) is issued with respect to the maximum number of cases per person, namely 50 elderly people, residing in the administrative-territorial area of the municipality of Oradea, who have directly addressed (by written request) the Social Assistance Directorate Oradea for the provision of social services. When appointing the CM, SPAS considers at least: the complexity of the case, the need to ensure continuity in the relationship between the beneficiary and SPAS/social service provider, the professional experience and knowledge of the CM regarding the typology of social services for the elderly, the CM's coordination, communication and collaboration skills, as well as the chronology of the registered requests.

FSS issues the appointment order for the case responsible. Decisions are communicated, as appropriate, between SPAS and FSS at local level.

CM/CR, in all activities carried out as part of the case management stages, respects the professional code of ethics, is based on the principle of respect for inalienable dignity, individual autonomy, including the freedom to make their own choices, and the independence of elderly persons.

Request for provision of social services

If the elderly person requests the support of the Social Assistance Directorate for access to social services, then SPAS carries out the entire procedure of evaluation, planning, issuing the order, etc. If the person does not address SPAS before accessing the social service or does not require the issuing of a service provision order as a social assistance measure, then SPAS receives and records the information regarding the existence of the beneficiary in the social service, notes the beneficiary in the Register of Vulnerable Elderly and monitors the situation according to legal provisions. In this case, the provisions for initial information, initial evaluation, intervention/service plan, appointment of a case manager from SPAS no longer apply.

The request for provision of social services may also be addressed directly to a private social service provider, in which case, if a service contract is concluded with the applicant, the provider is obliged to inform, in writing, the administrative-territorial authority on whose territory the beneficiary resides and to register the information in the National Register for Record of Persons Beneficiaries of Social Services.
