Issuance of the site endorsement for the authorization of construction works located in the vicinity of the natural gas objectives/transportation system*
Obtaining the location permit requested in the Urbanism Certificate, consists in following these steps:
1. Submission of the application and the related documentation, at the Territorial Operation of the company (competence for resolution is established according to the location where the future construction will be executed)

- Note: If the application is addressed incorrectly, it will be redirected to the competent Territorial Operation for resolution.
MANDATORY CONTENT OF THE DOCUMENTATION:
- Standard application -according to the attached model
- Technical report regarding the intended construction work;
- Copy of the Urbanism Certificate (validity period not expired)
- Zoning plan at scale 1:25,000 or 1:10,000; (or at an appropriate, explanatory scale)
- Site plan, signed and stamped, at scale 1:500 (or at an appropriate, explanatory scale). The site plan (current and proposed situation with furnishing) will be signed and stamped and, in editable .dwg format, will be drawn in stereo 70 coordinates, and must include the placement of the constructions in the proposed area, utility connections, and access roads related to the studied plot. The plan will also include a table with stereo 70 coordinates of the boundary points of the land.
The beneficiary (applicant) assumes that FAILURE TO SEND the above-mentioned documentation will result in extension of the processing time.
2. Registration of the application at the Territorial Operation.
3. Verification of the documentation and request for additions, if necessary;
If the documentation is not submitted as per the above structure/form, clarifications will be requested.
Clarifications will also be requested for the review fee (when applicable)
The fees charged for issuing the location permit are posted on the Transgaz website
CLARIFICATION REQUEST DEADLINE - maximum 10 days (calendar days) from the submission of the initial application.
DEADLINE FOR RESPONSE to clarifications – the beneficiary is obliged to respond to clarification/completion requests, to pay the fee (when requested) within a maximum of 60 days (calendar days) from the date the request for completion is received.
All clarifications/completions/paid fees are to be sent in a single email response.
4. Notification of the fee corresponding to the type of permit requested; issuance of the invoice and/or receipt;
If the applicant does not give consent, and does not make the payment, the application submitted cannot be further processed, the application will be closed.
Failure to send the response to clarifications and/or failure to pay the fee as requested and within the stipulated period leads to rejection of the application.
A REJECTION NOTICE will be issued and sent to the applicant
5. Allocation of necessary resources and scheduling of visit; travel to and from the designated location of the OTS technical team, for the identification and on-site verification of the location for which the permit is requested; and of the ST objectives;
6. Preparation of an opinion on the documentation through – marking the ST objectives on the layout plan structure, stating the GPS coordinates and vising the site plan.
NOTE: After this stage, the overall documentation will be considered complete; Complete documentation will be assigned a registration number.
7. The final documentation will be analyzed and the location permit will be issued by the competent structure
- For works located outside the safety zone, Territorial Operation analyzes the entire documentation and issues the location permit.
- For works located within the safety zone, Territorial Operation will forward the complete documentation for analysis and approval to the central office in Medias - D.E.M. – serv. A.C.P.C.,
RESOLUTION TIMEFRAME
- 15 days from the initial application registration- when the initial documentation is complete and NO fee is charged.
- 15 days from the date the beneficiary submits clarifications/completions/payment of the fee - when completions/clarifications/fee payment were requested.
8. Sending the permit to the applicant.
Location permits are received in scanned form at the email address indicated in the application.
The permit may be favorable, conditional, or unfavorable.
Will be issued:
- a favorable permit, if for the placement of the future construction the minimum safety distances provided in ANRE Order no. 118/2013 approving the Technical Norms for the design and execution of natural gas transmission pipelines are observed.
- an unfavorable permit, if for the placement of the future construction the minimum safety distances provided in ANRE Order no. 118/2013 approving the Technical Norms for the design and execution of natural gas transmission pipelines are not observed. In the case of an unfavorable permit, the reasons which led to the prohibition of the construction or work in the ST safety zone will be specified as well as how a favorable permit can be obtained. (relocation of the construction or, if possible, diversion of SNT objectives, at his own expense)
- a conditional permit, if the minimum safety distances are observed, but it is required to set specific technical conditions, by which the applicant is required to fulfill the technical conditions, at his own expense, prior to construction. Failure to fulfill these conditions results in the nullity of the permit.
