Obtaining the necessary approval for the sale of agricultural land outside the city limits*

The permit required for the alienation of agricultural land outside the built-up area may be requested by any person who owns agricultural land outside the built-up area, for the purpose of selling. The individual/legal entity will submit the application for posting the land sale offer (ANNEX 1A form), in order to notify the preemptors, accompanied by the land sale offer (ANNEX 1B form) and the supporting documents.
Within 5 working days from the registration of the application, the sale offer will be posted for 45 working days at the Săliștea Commune Town Hall headquarters and on the Town Hall website.
Within 5 working days from the registration of the sale application, the specialized department within the Town Hall will draw up the list of preemptors, which will be posted at the Town Hall headquarters and on the website.
During the 45 working days from the posting of the sale offer, the Town Hall will register all communications of acceptance of the land sale offer (ANNEX 1E form), submitted by any of the preemptors, accompanied by the following documents:
- copy of ID/ID card for the individual preemptor;
- copy of the certificate issued by the Trade Registry in the case of the legal entity preemptor;
- notarized copies of the supporting documents certifying the status of preemptor (co-ownership documents, lease contract, ownership documents of real estate bordering the land for sale, etc.).
The seller's decision regarding the selection of the preemptor as potential buyer will be registered at the Town Hall.
Within 3 working days from its registration, the specialized department will communicate, where appropriate, to M.A.D.R. or D.A.D.R. AB, the name and identification data of the selected preemptor, potential buyer.
The final permit required for entering into the authentic sale contract by the public notary is issued, as appropriate, by M.A.D.R. or D.A.D.R. AB.
If no preemptor communicates acceptance of the seller's offer, and the sale is free, the specialized department will issue the seller a certificate attesting that all procedural steps regarding the exercise of the right of preemption have been completed and that the land is free for sale, at the price provided in the sale offer. The certificate will be accompanied by a certified copy of the original sale offer.
Required documents:
- application for posting the land sale offer (ANNEX 1A form);
- land sale offer (ANNEX 1B form);
- a photocopy of the ID card of the individual seller or a copy of the passport for the individual seller with domicile abroad;
- a photocopy certified for conformity by the town hall officials of the ownership document for the land subject to the sale offer (as applicable: sale-purchase contract, donation contract, final and irrevocable civil sentence/decision, title deed, inheritance certificate, exchange contract, liquidation deed of patrimony or any other document provided by law attesting the acquisition of ownership);
- land register extract for information, issued not more than 30 days before posting the offer, accompanied by a cadastral plan extract, if the land is registered in the integrated cadastre and land register system;
- a photocopy of the certificate issued by the trade register or the document based on which it operates, in the case of the legal entity seller;
- in case of representation, notarial power of attorney, in a photocopy certified for conformity by the town hall officials, respectively delegation, decision of the general meeting of associates, decision of the sole associate, decision of the representative of the associative form, as applicable, in original, as well as a photocopy of the ID/ID card/passport of the empowered individual;
- decision of the general meeting of associates, decision of the sole associate, decision of the representative of the associative form, as applicable, in original, indicating the agreement regarding the sale of the asset owned by the company, in the case of the legal entity seller;
- tax attestation certificate issued by the town hall;
- other supporting documents, as applicable.
Collection of proposals according to Law no. 52/2003, Government Decision no. 831/2022*
The procedure mentions the process of public relations and information. Request for public interest information*
The procedure mentions the manner of ensuring free access to public interest information for citizens or other interested parties (media, NGOs, etc.) according to the provisions of Law no. 544/2001, with subsequent amendments and completions, within the City Hall. Through this procedure, the aim is to ensure a correct, efficient, operative, and legal circuit of requests for public interest information.
The operational procedure targets the free and unrestricted access of individuals to any public interest information, as defined by law, which constitutes one of the fundamental principles of the relationships between individuals and public authorities, in accordance with the Constitution of Romania and international documents ratified by the Parliament of Romania. The procedure establishes the manner in which communication is ensured to authorities, institutions, and interested individuals of the acts issued, under the conditions of Law no. 544/2001 regarding free access to public interest information.
The procedure is mainly carried out for good collaboration between citizens and public institutions, for the interests of the public institution, citizens, and employees of the public institution.
Are exempted from citizens’ free access the following information:
a) information in the field of national defense, security, and public order, if they are classified according to the law;
b) information regarding the deliberations of authorities, as well as those relating to Romania’s economic and political interests, if they are classified according to the law;
c) information regarding commercial or financial activities, if their publicity infringes on intellectual or industrial property rights, as well as the principle of fair competition, according to the law;
d) information regarding personal data, according to the law;
e) information regarding the procedure during a criminal or disciplinary investigation, if the result of the investigation is jeopardized, confidential sources are revealed, or the life, physical integrity, or health of a person is endangered as a result of the investigation carried out or ongoing;
f) information regarding judicial procedures, if their publicity affects the guarantee of a fair trial or the legitimate interest of any of the parties involved in the process;
g) information whose publication prejudices the measures for protecting youth.

The person whose surname or first name was recorded in civil status documents translated into a language other than their mother tongue or with the orthography of another language may request the registration – by a note on the margin of these documents – of the surname or first name retranslated or with the orthography of the mother tongue both in the sections regarding the holder and those regarding their parents.
The request is submitted to S.P.C.L.E.P. or, as the case may be, to the town hall of the administrative-territorial unit of residence or directly to S.P.C.L.E.P. or, as the case may be, to the headquarters of the town hall that keeps the civil status document.

(1) For issuing the urbanism certificate, the applicant - any interested natural or legal person - must submit to the issuer a documentation including:

1. identification details of the applicant;
2. identification details of the property for which the issuance of the urbanism certificate is requested, respectively locality, cadastral number and land register number, unless the law provides otherwise;
3. the elements that define the purpose of the request;
b) cadastral/topographic plans, highlighting the properties in question, as follows:
1. for properties not registered in the cadastre and real estate publicity records: area location plan, at one of the scales 1:10,000, 1:5,000, 1:2,000, 1:1,000, 1:500, as appropriate, issued, upon request, by the cadastre and real estate publicity office;
2. for properties registered in the cadastre and real estate publicity records: extract from the cadastral plan from the orthophotomap and updated information extract from the land register, issued, upon request, by the cadastre and real estate publicity office.
c) proof of payment of the urbanism certificate issuance fee, in copy.

The procedure establishes the way of communication to authorities, institutions, and interested persons of the acts issued by the director, under the conditions of Law no. 544/2001 regarding free access to information of public interest. The procedure is especially implemented to ensure good collaboration between citizens and public institutions, for the interests of the public institution, the citizens, and the employees of the public institution.
Granting social assistance*
The preparation of social assistance files aims to provide financial support to a single person or a family consisting of husband, wife, or husband, wife and their unmarried children, who are in their care, living, and managing their household together. Siblings without children who manage their household together and who do not have a domicile or residence are also considered a family.
Social assistance is granted monthly, supplementing the net monthly income of the family or single person, to ensure the guaranteed minimum income. The payment of social assistance is provided by A.J.P.I.S Alba, from the budget of the Ministry of Labor and Social Justice.
For the amounts granted as social assistance, one of the adult family members fit for work must perform, monthly, actions or works of local interest for all family members, without exceeding the normal working schedule; failure to fulfill this obligation leads to the suspension of social assistance, and if this obligation is not fulfilled within 3 months from suspension, the payment of social assistance ceases.
