Procedure regarding the certification of the professional personal assistant*
Verification of supporting documents and completion of the application regarding the certification of the professional personal assistant, aiming to inform the applicant about the processing of personal data according to REG (EU) 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the approval of Decision 95/46/EC, prior to submission to the institution’s Registry, for the purpose of carrying out the psycho-social evaluation of persons requesting certification as a professional personal assistant.
Assignment of the application and supporting documents to the multidisciplinary team (doctor, social worker, psychologist), appointed by the head of the service, for the purpose of carrying out the psycho-social evaluation and the proposal for certification as a professional personal assistant with notes regarding the number of persons, the degree of disability of adults who can be cared for, the applicant’s capacity to care for HIV-infected or AIDS-ill adult persons, or non-certification as a professional personal assistant.
Procedure regarding granting exemption for payment of the contribution for nursery and kindergarten services, starting with the 3rd child*
Granting exemption for payment of the contribution for nursery services is granted to parents/legal representatives who cumulatively meet the following conditions:
- have minors in their care who benefit from nursery services in a unit administered by DGASPC Sector 1;
- at least one of the parents/legal representatives has domicile in Sector 1;
- temporary residence or floating visa are not accepted;
- have at least 3 children in care; Granting exemption for payment of the contribution in kindergarten is granted to parents/legal representatives who cumulatively meet the following conditions:
- have minors in their care who attend a kindergarten within Sector 1;
- are without income or with low income, if this is below 1065 lei/family member per month;
- at least one of the parents/legal representatives has domicile in Sector 1 - temporary residence or floating visa are not accepted;
Operational procedure regarding the regulation of children performing paid activities in the cultural, artistic, sports, advertising, and modeling fields*
The operational procedure regarding the regulation of children performing remunerated activities in the cultural, artistic, sports, advertising, and modeling fields describes the activities of verifying the conditions for carrying them out. The procedure applies to children involved and remunerated in cultural, artistic, sports, advertising, and modeling activities.
*The classification of the child with disabilities as having a degree of handicap*
The procedure applies within the Secretariat Service for Committees for the purpose of complex evaluation, protection, and special care tailored to the needs of children with disabilities by assigning them a degree of disability. The files are prepared by the Services/Offices within DGASPC sector 1 and are forwarded to the Secretariat Service for Committees for the issuance of decisions and certificates of classification in the degree of disability, after the meeting of the Committee for Child Protection. The issuance of the Decision and the Certificate of classification in the degree of disability contains identification data for the applicant and beneficiary, the registration number of the comprehensive assessment/reassessment report which formed the basis for the recommendations for establishing the degree of disability, the degree of disability, the date of issuance of the certificate, and its validity. Each decision and certificate of classification in the degree of disability is prepared in two copies and confers specific rights and facilities to the holder and their relatives, according to the legislation in force. It is addressed to families with children with disabilities.
Procedure regarding the granting of the Minimum Inclusion Income (VMI)*
The application for establishing and granting the right to the minimum inclusion income and the income declaration are completed by the applicant based on civil status documents and income proof, and are submitted and registered together with all documents at DGASPC Sector 1, Prevention Service.
The Minimum Inclusion Income is granted to all single persons / families who have permanent residence or who live without legal forms in Sector 1, as well as homeless persons only for the period in which they are registered with DGASPC Sector 1 and who have the net income calculated according to the law less than or equal to the maximum levels established by law for each of the two components. For the inclusion aid, the maximum level of net income must be 346 Lei/person, respectively 504 Lei in the case of a single person aged at least 65. For the aid for families with children, the maximum net income level must be 880 Lei/family member.
The right to social assistance is established starting from the month following the one in which the application was submitted and after the social inquiry has been carried out.
* The payment of the Minimum Inclusion Income will be made by the Agency for Payments and Social Inspection of the Municipality of Bucharest.
Recruitment, Evaluation and Training of the Placement Person/Family*
Procedure regarding the granting of the child-raising allowance*
Evaluation procedure for certification as a professional maternal assistant .*
The maternal assistant is the individual, certified according to the law, employee of the general directorate of social assistance and child protection, who ensures at his/her home or, as the case may be, at his/her residence, the upbringing, care, and education of the child during the application of the special protection placement measure, emergency placement for the child separated, temporarily or permanently, from his/her parents or, as the case may be, during the respite period of another maternal assistant. The conditions that a person wishing to become a maternal assistant must cumulatively meet are specified in Ordinance no. 27/01.08.2024 regarding the conditions for obtaining the certificate, the certification procedure and the status of the maternal assistant.
The person who wishes to become a maternal assistant submits an evaluation request to the directorate in the county, or the sector of Bucharest municipality where he/she has domicile or, as the case may be, residence. The request must state the number of children for whom the applicant considers he/she can simultaneously provide optimal conditions for growth, care, and education, namely one or two children, the age group, availability to care for groups of siblings, children with disabilities, as well as the availability to take children in emergency regime or during the respite period of another maternal assistant. The following documents must be attached to the evaluation request:
a) applicant’s curriculum vitae;
b) copy, certified by the directorate or, as the case may be, by the applicant, of the identity card/passport, long-term residence permit or, as the case may be, permanent residence card of the applicant and, as the case may be, of each person with whom he/she lives;
c) copy, certified by the directorate or, as the case may be, by the applicant, of the birth certificate of the applicant and, as the case may be, of each person with whom he/she lives;
d) copy, certified by the directorate or, as the case may be, by the applicant, of the marriage certificate or divorce decision/divorce certificate, if applicable;
e) copy, certified by the directorate or, as the case may be, by the applicant, of his/her diploma;
f) copy, certified by the directorate or, as the case may be, by the applicant, of the ownership title or any other document attesting the right to use the dwelling;
g) applicant’s criminal record and, as the case may be, of each person over 14 years of age with whom he/she lives;
h) behavioral integrity certificate of the applicant and, as the case may be, of each adult with whom he/she lives, obtained according to art. 16 of Law no. 118/2019 regarding the National automated registry for persons who have committed sexual offences, exploitation offences or offences against minors, as well as for the modification of Law no. 76/2008 regarding the organization and functioning of the National System of Judicial Genetic Data, with subsequent amendments;
i) income certificate or other documents attesting the applicant's income or, as the case may be, of at least one of the adult members of the family with whom he/she lives;
j) medical certificate issued by the family doctor regarding the applicant’s state of health, stating that he/she does not suffer from communicable diseases, and, as the case may be, of each adult with whom he/she lives;
k) medical certificate issued by a specialist stating that the applicant or, as the case may be, the adults with whom he/she lives, do not suffer from mental illnesses;
l) authenticated declaration on own responsibility stating that the applicant is not in any of the following situations:
-has been deprived of parental rights by a final court decision or has been prohibited from exercising parental rights as a complementary penalty;-
-has had or, as the case may be, has one or more biological children in the special protection system;-has consented to the adoption of his/her own child, except where the child was adopted by the spouse;-the maternal assistant certificate has been withdrawn, except where the certificate was withdrawn at his/her own request.m) recommendations from neighbors, relatives of the applicant, other community members/social circle or, as the case may be, from the representatives of local public administration authorities, regarding the social behavior of the applicant and, as the case may be, of the family members with whom he/she lives. The expenses necessary to obtain all the documents accompanying the evaluation request are borne by the applicant. The evaluation request provided above is resolved within 90 calendar days from the date of registration with the directorate.The evaluation requested through the aforementioned application is carried out by a team, designated by the management of the directorate, consisting of a psychologist and a social worker, the latter usually being responsible for preparing the final report, and includes the following stages: the evaluation stage and the training stage. The evaluation stage itself includes social evaluation and psychological evaluation which are conducted during at least four meetings. The meetings for social and psychological evaluation take place at the applicant's home or at the directorate’s headquarters. Each team member is required to conduct at least one of the evaluation meetings at the home or, as the case may be, at the residence of the applicant.
After the social and psychological evaluation in view of preparing for the exercise of the activity as a maternal assistant, the applicant participates in the training courses. The applicant who is a graduate of university studies in social work, psychology, or educational sciences does not have to attend the training courses.
UAfter going through the evaluation and preparation stages for carrying out the activity of maternal assistant, the evaluation team members prepare the final evaluation report on the capacity to care, raise, and educate a child or, as the case may be, several children.
The final evaluation report is communicated to the applicant within 10 working days from its registration at the directorate, with acknowledgment of receipt, by mail or electronic mail, at the address indicated by the applicant.
The applicant who has received the report submits a request at the directorate’s headquarters in his/her domicile addressed to the child protection commission which is resolved within 30 calendar days from the date of registration at the directorate. The maternal assistant certificate is issued for an indefinite period and is reviewed every two years based on activity evaluation.
Procedure regarding the enrollment, maintenance, transfer, and exit of children from day centers whose parents pay the monthly maintenance contribution*
The method of registration, maintenance, transfer, and withdrawal from day centers (nursery) for children of pre-preschool age, whose parents pay the daily meal allowance.
We mention that at registration, priority is given to children whose parents (one or both) have their domicile or residence in Sector 1 at the time of submitting the application. Registrations are usually made at the beginning of the school year in the order in which the parents submit the application. In certain situations, registrations are also made during the school year in the order of application submission and of the available spots announced in writing by the center. The parent/legal representative of the child submits only one application for enrolling the child at the nursery, containing only one enrollment option. In case the parents indicate several nurseries on the application, they will be contacted in writing in order to clarify the situation and select only one nursery. Applications later submitted by the same parents for enrolling the child at other nurseries under the DGASPC Sector 1 will annul the previous ones, and the last submitted application will be taken into account, the parents being informed in writing regarding this matter.
*Procedure regarding the issuance of certificates stating whether the applicant is registered in the records of D.G.A.S.P.C. Sector 1 as a person with disabilities or not.*
The procedure refers to the issuance of certificates stating whether the applicant is registered in the records of D.G.A.S.P.C. Sector 1 as a person with disabilities or not. It is addressed to individuals who have their domicile / residence within Sector 1.
*Certificate that the person/family is fit to adopt*
It is addressed to individuals/families with domicile/residence in Sector 1 who wish to adopt adoptable children in the protection system.
Individuals/families who have not obtained a certificate of suitability to adopt may file an appeal within 5 days from the communication of the evaluation result to the General Director of DGASPC Sector 1.
Procedure regarding the registration of the child with disabilities*
Identification of children with disabilities and learning and socio-school adaptation difficulties, who require classification into a degree of disability, following direct requests, referrals from specialists who come into contact with children with disabilities, and ex officio notifications.
It is addressed to children with disabilities and special educational needs, from Sector 1, following the complex assessment a certificate of classification into a degree of disability is issued.
*Procedure regarding the issuance of certificates related to the agreement for the payment of interest on loans for car purchase / home improvement*
The procedure involves establishing the method for issuing certificates regarding the agreement for the payment of interest on loans for the purchase of a car or the arrangement of a home by D.G.A.S.P.C. Sector 1. The beneficiaries are persons with disabilities who have their domicile or residence in Sector 1.
*Matching with an adoptable child within the internal adoption procedure and entrustment for adoption*
Identifying the most suitable person or family for the adoptable child is done by matching in the National Adoption Registry through the issuance of the matching list or by accessing the public profile of the adoptable child. The matching process can be finalized with the request for entrusting for adoption.
